Richmond Municipal Code Ch. 10.06 Conduct of Library Patrons

10.06.010 - Prohibited conduct.¶
It shall be unlawful for any person while in a public library, including but not limited to the foyer, restrooms, and enclosed rooms, to commit any of the following acts:
(1) Making or causing to be made a loud, unnecessary or unusual noise or any sound which annoys other persons in the library or which disturbs or disrupts the quiet environment of the library;
(2) Threatening, intimidating, harassing, or abusing, by acts or words, any other person;
(3) Indecency or profanity, by acts or words, which disturbs or disrupts the quiet environment of the library;
(4) Intentionally defacing, breaking, or damaging, property of other persons or belonging to the City;
(5) Making or causing to be made a foul or offensive odor which is under said person's control;
(6) Making or causing to be made smoke or fire;
(7) Leaving children of the age of seven and under unattended by a supervising adult;
(8) Not wearing shoes or shirt;
(9) Eating food or drinking beverages except when medically necessary;
(10) Running, jumping, swinging, or using furniture or structures in an inappropriate or hazardous manner;
(11) Soliciting from, begging from, or selling to another person;
(12) Bringing or causing to be brought into the library any animal, mode of transportation (except baby strollers), or unusual object unless it is necessary to assist individuals with disabilities;
(13) Washing the body other than hands and face, cutting or washing hair, or changing or washing clothes;
(14) Sleeping or lying on the floor;
(15) Acts or conduct which endangers the health or safety of any person(s) in or about the library.
For the purpose of this section, the following sounds are declared to be loud and disturbing noises in violation of this section: sounds emanating from radios, DVD players, CD players, cell phones, phonographs, televisions, musical instruments, or other machines or devices made for the production of sound, except as permitted by an employee of the library; yelling, shouting, loud talking or singing, except as permitted by an employee of the library; and, the creation of noise outside but adjacent to the library which can be heard by persons inside the library building.

10.06.020 - Failure or refusal to leave.¶
(a) Any person who has committed one of the violations set forth in Section 10.06.010 is required to leave the library building for seventy-two (72) hours upon request by a library staff member employed by the City of Richmond. In making the request, the library staff member shall state the violation committed by the person and hand him or her a copy of this chapter.
(b) Penalty. It shall be a misdemeanor for any person to fail or refuse to leave immediately upon a second request to leave by the library staff member.
10.06.030 - Prohibition from library building.¶
Any person who enters the library building within 72 hours after having left the library pursuant to Section 10.06.020 shall be guilty of a misdemeanor. In addition, the person may be required by a librarian in charge to leave the library building for ten days from the date of reentry. Any person who enters the library building within 10 days after having left the library pursuant to this section, shall be guilty of a misdemeanor.
10.06.040 - Appeal.¶
Any person required to leave the library building pursuant to this chapter shall be entitled to appeal in writing the restriction to the office of the City Manager ("Office"). If the restriction is for seventy-two (72) hours, the Office shall forthwith designate a professional City employee to meet with the person and the employee shall render a decision at that time. If the restriction is for ten (10) days, the Office shall designate a professional City employee to meet with the person within two (2) work days of the submission of the appeal and the employee shall render a decision at the time of the meeting. The decision of the employee shall be final.
