5.12.010 - Purpose.¶
This Title is enacted to provide minimum standards to insure the personal health, well-being and safety of marina residents and others using marina facilities.
5.12.020 - Scope.¶
The provisions of this chapter shall apply to all marinas located wholly or partially within the incorporated area of the city of Richmond.
a. New Marinas. Construction of any marina subsequent to the effective date of the ordinance codified in this chapter shall comply with the requirements of this chapter.
b. Existing Marinas. Existing facilities in any marina in existence prior to the effective date of the ordinance codified in this chapter shall not be subject to the requirements of Section 5.12.060. Each replacement or new facility in a marina in existence prior to the effective date of the ordinance codified in this chapter shall comply with the requirements of this chapter.
5.12.030 - Definitions.¶
For purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them in this section:
a. A "marina" is a waterfront facility that provides berthing for recreational vessels, and/or floating homes and may offer supply, repair, storage, launching and other services for those vessels. A "marina" does not include a private residence or other facility such as a restaurant or boat repair yard where the berthing of a vessel is only incidental to the primary function of the structure.
b. A "vessel" is any type of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on the water.
c. A "houseboat" is a floating nonmobile structure, barge, raft or boat which is attached to any land, building or premises by way of anchors, lines, or other means, has facilities for sleeping and food preparation, is used or designed for use primarily as a place of habitation, and is not used primarily for transportation, recreation, pleasure or commercial purposes.
5.12.040 - Administration and enforcement.¶
The provisions of this chapter shall be administered and enforced by the director of public works of the city of Richmond.
All departments, officials, and public employees of the city of Richmond vested with the duty or authority to issue permits shall conform to the provisions of this chapter; and any such permit issued in conflict with the provisions of this chapter shall be null and void.
