5.12.070 - Houseboat permit requirements.¶
It shall be unlawful for a marina owner or operator to lease, rent, or hold out for lease or rent a berthing space for a houseboat unless he has obtained a valid marina operating permit as specified in Section 5.12.050 and he obtains a houseboat operating permit as hereinafter provided for each houseboat berthing space. In areas zoned C-C coastline commercial, a conditional use permit must also be obtained from the Richmond planning commission.
a. Applications for New Houseboat Marinas. An application as specified in Section 5.12.050, subsection (a), shall be submitted to the director of public works for new marinas which permit houseboats. In addition to the information specified in the aforementioned section, the application shall contain the following:
- Location and dimensions of each houseboat moorage site.
b. Applications for Existing Houseboat Marinas. This provision is the same as Section 5.12.050, subsection (b) of this chapter.
c. Fee. A fee, set by city council resolution, shall be charged for each houseboat mooring space.
d. Issuance. In order for a houseboat permit to be issued, a marina must obtain a marina operating permit as specified in Section 5.12.050 and comply with the supplemental houseboat moorage requirements as specified in Section 5.12.080 of this chapter. If the director of public works, after investigation, determines that those requirements have been complied with and the leasing of a berth to a houseboat will not create a hazard to the health, welfare or safety of the occupants of the houseboats moored therein or other users of the marina, he shall issue a houseboat permit. All houseboat permits may be made subject to such conditions as the director of public works may deem appropriate to insure compliance with the provisions of this chapter.
e. Posting. This provision is the same as Section 5.12.050, subsection (e) of this chapter.
f. Term—Renewal. This provision is the same as Section 5.12.050, subsection (f) of this chapter.
g. Inspection—Revocation. This provision is the same as Section 5.12.050, subsection (g) of this chapter.
h. Appeals and Variances. This provision is the same as Section 5.12.050, subsection (h) of this chapter.
5.12.080 - Supplemental houseboat berthing requirements.¶
These standards, in addition to those specified in Section 5.12.060 of this chapter, shall apply to a marina which rents or holds out for rent any site or space for the establishment of a houseboat: a. Register of Ownership of Houseboats. Every owner or operator of a houseboat berth shall maintain a current register of every houseboat moored on the premises under his control, such register to record the name and address of the legal owner of each houseboat. A copy of said register shall be furnished to the director of public works on request.
b. Sanitary Sewage Disposal. Every houseboat moored at a marina shall be lawfully connected to an approved local sewer. If a public sewer is not available to a marina other methods of collecting, handling and treating the collected sewage which are acceptable to the city of Richmond may be used.
c. Greywater Disposal. A system for the disposal of greywater which has been approved by the Contra Costa County health department shall be provided for each houseboat. "Greywater" means the wastewater from the houseboat (exclusive of toilet waste), such as water from a laundry, bath, shower, or sink.
d. Fire Protection. Each houseboat shall have an approved smoke detector located near the sleeping areas. Location and mounting of smoke detector shall be approved by the fire department.
