Rialto Municipal Code Ch. 8.40 Inspection Grading of Food Establishments

8.40.010 - Scope.¶
The provisions adopted herein for the inspection grading of food establishments shall apply at all times, anywhere within the city where food and/or beverage products are sold or served by a retail food establishment at a permanent location.

8.40.020 - Adoption of San Bernardino County Code provisions.¶
A. The city of Rialto adopts and makes a part of this chapter by reference the following portions of the San Bernardino County Code, related to the inspection and grading of food establishments:
Chapter 14 of Division 3 of Title 3;
Subsection 16.0213B(b)(17) of Chapter 2 of Division 6 of Title 1.
B. The aforementioned sections of the San Bernardino County Code, adopted by San Bernardino County Ordinance No. 3930, is adopted as the inspection grading of food establishments program of the city of Rialto.

8.40.030 - Enforcement agency designated.¶
The county of San Bernardino, Department of Public Health, Division of Environmental Health Services is designated as the enforcement agency for the city and is authorized to provide the qualified personnel necessary to enforce the provisions of this chapter.

8.40.040 - Adoption and collection of fee.¶
The fee contained in San Bernardino County Code subsection 16.0213B(b)(17) of Chapter 2 of Division 6 of Title 1 is adopted as the fee in effect in the city and shall be applicable within the city to provide for the costs of administration and enforcement of the inspection grading of food establishments program of the city of Rialto. The city council finds and determines that the fee adopted herein is reasonably related to the actual cost of administration and enforcement of the inspection grading of food establishments program. The San Bernardino County, Division of Environmental Health Services shall collect the fee, for deposit with the county treasurer, to offset the costs assumed by the county in administering and enforcing the program for and within the city of Rialto.

8.40.050 - Violations—Penalty.¶
A. It is unlawful to operate a food establishment unless the letter grade card issued by the Division of Environmental Health Services is posted in a prominent place, easily viewed by the public.
B. In accordance with Section 33.1406(c) of the San Bernardino County Code, the letter grade card posted in accordance with the program shall not be defaced, marred, camouflaged, hidden, or removed.
C. Removal of the letter grade card is a violation of the program adopted herein, and may result in the suspension or revocation of the public health permit and shall be punishable as specified in Section 33.0112 of the San Bernardino County Code, which is adopted herein and incorporated by reference.
