ARTICLE A. FIRE DEPARTMENT

1-8A-1: ESTABLISHMENT:

The fire department and the office of fire chief are hereby created and established. The fire chief shall receive such compensation and benefits as may be provided annually in the city budget. (Ord. 2005-02, 1-25-2005; amd. 2007 Code)

1-8A-2: FIRE CHIEF:

A. Appointment; Supervision: The fire chief shall be appointed or removed by the city manager. The city manager shall be the immediate supervisor of the fire chief, and all policies, directives and orders to the fire chief shall be made by or transmitted through the city manager.

B. Powers And Duties: The fire chief shall be responsible for enforcing applicable state and local laws and ordinances and shall direct the administration and operation of the fire department. (Ord. 2005-02, 1-25-2005)

1-8A-3: DUTIES OF FIRE DEPARTMENT MEMBERS:

Members of the fire department shall attend all fire and rescue incidents in the city and perform such duties in suppressing any fire, facilitate rescue operations and mitigate hazardous situations as may be directed by a fire officer. Additionally, members of the fire department shall assist with fire suppression and rescue duties in locations outside the city when directed to do so by a fire officer. (Ord. 2005-02, 1-25-2005)

1-8A-4: RULES AND REGULATIONS:

A. Adoption Of Rules And Regulations: The fire chief shall cause to be adopted, maintained and enforced an up to date comprehensive set of rules and regulations governing the discipline, training and operation of the fire department. Such rules and regulations and any deletions, changes or additions thereto shall not be deemed the exclusive authority or power of the fire chief, but he shall have such further and additional authority reasonably necessary and convenient to carry out the purposes and intents of the provisions of this chapter and to fulfill the duties and requirements of the fire department.

B. Enforcement: The fire chief shall carry out and enforce the rules and regulations of the fire department and is authorized to suspend or remove from service any officer or firefighter, as provided in the rules and regulations. (Ord. 2005-02, 1-25-2005)

ARTICLE B. POLICE DEPARTMENT

1-8B-1: CHIEF OF POLICE:

A. Office Created: The department of police shall be under the direction and control of the chief of police, which office is hereby created 1 .

B. Appointment: The chief of police shall be appointed by the city manager 2 . The chief of police may appoint, subject to the approval of the city manager, one or more police officers.

C. Duties: The chief of police shall have such powers and must perform such duties as now or may from time to time be provided by law now in effect or hereafter enacted. (Ord. 734, 5-9-1990)

1-8B-2: STATE AID FOR TRAINING AND RECRUITMENT:

The city council declares that it desires to qualify to receive aid from the state of California under the provisions of Penal Code chapter 1 of title 4, part 4. Pursuant to Penal Code section 13522, the city, while receiving aid from the state of California, will adhere to the standards for recruitment and training established by the California commission on peace officer standards and training. (Ord. 734, 5-9-1990)

1-8B-3: RESERVE POLICE OFFICERS:

Pursuant to the provisions of Penal Code section 832.6(b), all reserve officers of the Reedley police department who have been issued a "level 1 reserve officer" certification prior to January 1, 1981, are hereby determined to be qualified to perform general law enforcement duties by reason of their training and experience and are hereby designated as peace officers and shall have the full powers and duties of a peace officer as provided by Penal Code section 830.1. (Ord. 734, 5-9-1990)
