§ 9-21.101. Purpose.

(a) It is the purpose of this chapter to provide a procedure for the abatement of imminently hazardous buildings, structures and parcels of land which remedy shall be cumulative with that provided in Chapter 11 herein under the Uniform Code for Abatement of Dangerous Buildings and with other remedies provided by law for the abatement of buildings, structures and parcels of land which for any cause endanger the life, health or safety of the public or the safety or usefulness of property.

(b) It is recognized that situations may occur whereby the danger to life, health or safety of the public or to property is so imminent that the procedures set forth in said Uniform Code and other laws of the State and City do not, in the judgment of the City's Building Official, provide a timely mechanism for the protection of life, health and safety of the public or the safety or usefulness of property and, therefore, that it is necessary to provide the remedy set forth in this chapter.

§ 9-21.102. Abatement as public nuisance.

All buildings, structures and parcels of land or portions thereof which are determined by the Building Official, after inspection, to be imminently hazardous as defined in Section 9-21.104 are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition, removal, regrading, excavation, shoring, recompaction or other work in accordance with the procedures specified in this chapter.

§ 9-21.103. Right of inspection.

When it is necessary to make an inspection to enforce the provisions of this chapter, or when the Building Official has a reasonable cause to believe that there exists in a building, structure or upon any parcel of land a condition which makes such premises imminently hazardous, the Building Official may enter such premises at reasonable times to inspect or to perform the duties imposed by this chapter; provided, however that, if the premises are occupied, that credentials be presented to the occupant and entry requested. If such premises are unoccupied, the Building Official shall first make a reasonable effort to locate the owner or other person having charge or control of the premises and request entry. If entry is refused, the Building Official shall have recourse to the remedies provided by law to obtain entry.

§ 9-21.104. Definitions.

For the purpose of this chapter, the words set out in this section shall have the following meanings:

"Building"

is any structure used or intended for supporting or sheltering any use or occupancy.

"Building Official"

is the City's Chief Building Officer or designee.

"City Engineer"

is the Director of Public Works/City Engineer or designee.

"Imminently hazardous building, structure or parcel of land"

is one which, or any portion of which, is in a condition of structural weakness or instability from whatever cause that it is a danger to life, health or safety of the public or property and that such hazard is so imminent that the risks therefrom require summary or immediate action to avoid serious harm to the public or property.

"Structure"

is that which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner.
