§ 2-20.01. Board of appeals established.

There is hereby created a Board of Appeals under the provisions of the Uniform Building Code, the Uniform Code for the Abatement of Dangerous Buildings, the Uniform Housing Code, the Uniform Sign Code, the Uniform Mechanical Code, the Administrative Code Provisions for the National Electrical Code, and Title 9 of the Redondo Beach Municipal Code.

§ 2-20.02. Membership.

The Board shall be appointed by the Mayor, subject to confirmation by the City Council, and shall consist of three members, one of which shall be a California State licensed architect, one a California State licensed civil or structural engineer, and one a California State licensed general contractor, who are qualified by experience and training to pass upon matters pertaining to building construction, who are not employees of the City, and who are electors of the City.

The Board shall also consist of three alternate members who have the same qualifications as the members and shall be appointed for the same term as the members. In the event of the absence or unavailability of a member for any meeting, the alternate member with the same qualifications shall serve in his or her place at that meeting.

The original term of one member shall expire on September 30, 1994; the original term of one member shall expire on September 30, 1995 and the original term of one member shall expire on September 30, 1996. Thereafter, all members shall be appointed for a term of four years and until his or her successor is appointed and qualified.

The Chief Building Official shall be an ex officio member of the Board, and shall act as its secretary. The Chief Building Official shall not be entitled to vote.

§ 2-20.03. Powers and duties.

(a) The Board shall hear and decide appeals taken from any order, notice and order, or any action or determination of the City's Chief Building Official which is appealable under the provisions of the codes described in Section 2-20.01 of this chapter. The Board shall have no authority relative to interpretation of the administrative provisions of said codes nor shall the Board be empowered to waive requirements of said codes. All Board decisions shall be final and conclusive as to the Community Development Department of the City, in the absence of fraud or abuse of discretion.

(b) The Board shall adopt regulations establishing procedural rules and criteria for carrying out its duties.

§ 2-20.04. Fees.

The fees for filing appeals shall be equal to the fees for filing appeals to the Handicapped Access Appeals Board, which is set by Council resolution. Such fees shall be paid to the Secretary of the Board at the time of filing the appeal. Payment of such fee shall be a condition of the validity of the appeal application.
