§ 9-21.301. Failure to obey order a misdemeanor.

After any order of the Building Official made pursuant to this chapter shall have become final, no person to whom any such order is directed shall fail, neglect or refuse to obey such order. Any person who fails to comply with any such order is guilty of a misdemeanor.

§ 9-21.302. Enforcement of order.

If, after any order of the Building Official has become final, the person to whom such order is directed shall fail, neglect or refuse to obey such order, the Building Official may (i) cause such person to be prosecuted under Section 9-21.301 and/or (ii) abate such public nuisance as provided in Article 4 of this chapter.

§ 9-21.303. Order to vacate building.

Whenever the required repair or demolition of any building or structure or work on any parcel of land is not commenced after any final notice and order therefor issued under this chapter becomes effective, the Building Official shall cause such premises to be vacated by posting an appropriate notice at each entrance to such building or structure, or if none, at an appropriate place on the premises.

§ 9-21.304. Occupation of premises and removal of notice forbidden.

(a) No person shall occupy any premises which have been posted as specified in this section.

(b) No person shall remove or deface any such notice so posted until the repairs, demolition or removal or other work ordered by the Building Official have been completed and a final City approval for occupancy issued pursuant to the provisions of the Building Code.

§ 9-21.305. Recordation of notice and order.

(a) If compliance with the order is not achieved within the time specified therein, the Building Official shall file in the office of the County Recorder a certificate describing the property and certifying (i) that the building, structure or parcel of land is imminently hazardous and (ii) that the owner has been so notified.

(b) Whenever the corrections ordered shall thereafter have been completed or work accomplished so that the premises are no longer imminently hazardous, the Building Official shall file a new certificate with the County Recorder certifying that such premises are no longer imminently hazardous.
