2.36.010: EXISTENCE:

There is a Planning Commission which shall serve as the planning agency of the City. (Ord. 1951 § 1, 1986: Prior Code § 18901)

2.36.020: MEMBERSHIP:

A. Membership and Selection of the Planning Commission.

  1. The Planning Commission shall consist of seven (7) members appointed by the City Council.

  2. The members shall be selected pursuant to procedures and guidelines adopted by City Council resolution.

B. Terms.

  1. Each member shall serve for a four (4) year term until his or her successor is appointed.

  2. No person shall serve more than two (2) consecutive full terms unless appointed to an additional term by a four-fifths (4/5) vote of the City Council.

  3. The terms of the members shall be staggered such that the terms of not more than three members shall expire in any year.

  4. Members whose initial appointments are less than one-half the full term of four (4) years will be allowed to serve their partial term and then two full terms.

C. Vacancies. Vacancies on the commission shall be filled in accordance with the procedures and guidelines adopted by City Council resolution, and with the approval of the City Council for the unexpired portion of the term. Appointments made to fill an unexpired term will constitute a full term if more than two (2) years of a term remains.

D. Compensation. The members of the commission shall serve without compensation, shall each be a resident of the City, and neither a member of any other standing commission, board or committee of the City nor an employee thereof.

E. Removal. The City Council may remove any member of the commission at any time, without or without cause, by a majority vote.

F. Quorum. Four (4) members of the commission shall constitute a quorum. (Ord. 2981 § 1, 2025: Ord. 2751, 2011)

2.36.022: FORFEITURE OF MEMBERSHIP BY ABSENCE:

Any member of the commission who absents himself or herself from any three (3) consecutive regular meetings of the commission, unless excused from such absence by consent of the commission expressed by action recorded in its minutes, shall thereby automatically forfeit his or her position as a member of the commission immediately after adjournment of any such third consecutive meeting at which such member has not appeared. The Chairperson or Secretary of the commission shall thereupon, within three (3) business days, notify in writing the City Council, and any such person so ceasing to be a member of the commission, of such fact; whereupon the vacancy so created shall be filled by appointment pursuant to section 2.36.020 of this chapter. 2.36.030: ORGANIZATION AND MEETINGS:

The commission shall annually elect from its number a Chairman, who shall serve for a term of one (1) year, and such other officers as the commission may deem advisable. Except as otherwise provided in this Code, or by the laws of this State, the commission shall provide for its own organization, shall adopt rules and regulations for the transaction of business before it, and shall designate the time and place for its regular monthly meeting or meetings. The commission may use the Council Chambers as the place for its meetings, provided that such meetings do not conflict or interfere with meetings of the City Council. 2.36.040: POWERS AND DUTIES:

As planning agency of the City, the Planning Commission shall have such powers and duties as are provided for such agencies by the general laws of the State. In addition, the commission shall have such powers and duties as are provided by City ordinance. The commission shall keep proper records of all of its official acts and proceedings. 2.36.050: HEARING; APPLICATION:

Applications are filed with the Development Services Department on forms provided by the Department with the applicable filing fee(s) established by Council resolution. A complete application shall be filed not less than sixty (60) days prior to a hearing date. The hearing date shall be determined by the Department. (Ord. 2981 § 3, 2025: Ord. 1000, 1955)

2.36.060: HEARING; PROCEDURES:

Planning Commission hearing procedures shall be as follows:

A. Director will present a report and recommendation to the commission.

B. Following discussion the Chairman will open the meeting for public hearing.

C. The applicant and persons favoring the application are invited to speak first.

D. Protestants may speak to the subject following applicant's presentation and those supporting the application.

E. Following the opposition arguments, the applicant is permitted a short period of rebuttal.

F. Chairman will close the hearing and call for discussion and a motion on the subject. (Ord. 1000, 1955)

2.36.070: HEARING; COMMISSION ACTIONS:

A. Commission action on a variance is final unless appealed.

B. The City Council is not required to act on a commission recommendation for denial of a zone change. A commission recommendation for approval is forwarded to the City Council for action.

C. The City Council may approve, modify, or reject any decision of the Planning Commission subject to certain procedures established in the zoning ordinance for the particular application. (Ord. 2981 § 4, 2025: Ord. 1000, 1955)

2.36.080: HEARING; APPEALS:

Any interested citizen or applicant may appeal a decision of the Planning Commission. Appeals shall be filed in writing with the City Clerk. (Ord. 1000, 1955)
