7.24.010 - Purpose.

The purpose of this chapter is to afford additional protection to wild birds within the city and to aid in the preservation of all species of wild birds typical to this geographical area, by establishing designated bird sanctuaries on portions of property owned or leased by the city and located within the city's boundaries, in the belief that wild birds not only have great economic value in aiding in the destruction of insect and worm pests, but also provide one of the best opportunities for our citizens to observe wildlife, and in the further belief that the protection and preservation of wild birds will benefit all the citizens of our city.

7.24.020 - Established.

That portion of the city owned by the city and devoted to park or designated types of recreational uses and most commonly known as Turtle Bay and Turtle Bay East, and depicted on that map of a designated portion of the city attached to Ordinance No. 1087, on file in the office of the city clerk, as "Exhibit A" and incorporated in this chapter by reference, is declared to be a wild bird sanctuary. All of the prohibitions set forth in this chapter shall apply within any wild bird sanctuary established by the city council.

7.24.030 - Molesting birds and eggs prohibited.

Within any established wild bird sanctuary, no person shall, at any time, hunt, pursue, kill, trap, take or destroy any bird of any species whatsoever, and no person shall molest or damage the nest or the eggs of any bird of any species located within the confines of the sanctuary, except, however, that the city council may, at any time, when in its opinion starlings or crows or any other species of bird becomes so numerous within a designated bird sanctuary as to constitute a public nuisance or a danger to the public health, direct the animal control officer to take such measures as may be necessary to control the problem and eliminate the public nuisance or danger to the public health.

7.24.040 - Sign erection.

In any area designated a bird sanctuary by the city council, the city council shall cause signs to be erected notifying the public that the designated area is a bird sanctuary, and the signs shall be placed at appropriate locations within and along the perimeter of the sanctuaries.
