4.26.010 - Purpose.

The city council declares that the fees required to be paid are assessed pursuant to the power of the city and are in the nature of an excise tax for the sole purpose of producing revenue. The continued increase in the development of land within and without the city, with the attendant increase in the population of the city by annexation, as well as new construction, has created an urgent need for the planning, acquisition, improvement, and expansion of sewer and water facilities with which to serve the ever increasing population of the city, and for the means with which to finance such planning, acquisition, improvement, and expansion of public facilities and services.

4.26.020 - Definitions.

The definitions provided in Chapter 16.42 shall apply in this chapter.

4.26.030 - Applicability.

The tax provided for in this chapter is intended to apply to all existing residential construction and nonresidential construction, annexed into the city on or after July 1, 1978, at the time it connects to the sewer or water system of the city.

4.26.040 - Time of payment.

The connection charge or tax imposed in this chapter shall be due and payable at the time of application to connect to the sewer or water lines of the city.

4.26.050 - Place of payment.

The connection charges shall be paid to the city treasurer or her authorized agent at the office of the city treasurer at the city hall. The treasurer's receipt for such payment shall be presented to the department of public works of the city as a necessary prerequisite to the connection of such existing construction to either the sewer or water system at the time of such application.

4.26.060 - Connection charges imposed.

The connection charge for sewers shall be in the same amount and computed in the same manner as the computation of the wastewater treatment element of the construction tax set forth in Section 16.42.060. The connection charge for water shall be in the same amount and computed in the same manner as the computation of the water service element of the construction tax set forth in Section 16.42.060.

4.26.070 - Use of revenue.

The connection charges collected pursuant to the provisions of this chapter shall be placed in a special fund for each charge, which is created and established for such purpose, and shall be known by the name of the sewer connection annexation charge fund and the water connection annexation charge fund. Taxes and charges collected pursuant to this chapter shall be used and expended solely for the purposes set forth in Section 4.26.010.
