§ 8.5 ADOPTION.

(A) For the purpose of prescribing regulations governing conditions hazardous to life and property from fire, hazardous materials or explosion, certain documents of the California Code of Regulation Title 24 entitled:

(1) The 2022 Edition of the California Fire Code, Part 9 together with Appendix Chapters 4, B, C, D, E, F, and standards, as well as, the 2021 International Fire Code of the International Code Council; save and except such portions as are hereunder deleted, added, modified, or amended by this Chapter;

(2) The 2022 Edition of the California Building Code Part 2 Vol. 1 and 2;

(3) The 2022 Edition of the California Residential Code Part 2.5.

Are hereby adopted by the City Council as the fire code of the city and included in and made a part of this code as though set forth at length herein. A copy of the code is maintained in the Office of the Fire Marshal for examination and use by the public.

§ 8.6 TITLE .

(A) § 101.1 of the 2021 International Fire Code is amended to read as follows:

(1) These regulations shall be known as the Fire Code of the City of Red Bluff, hereinafter referred to as "the Fire Code."

§ 8.7 SUPPLEM ENTAL RULES, REGULATIONS AND STANDARDS.

(A) § 104.1 of the 2021 International Fire Code is added to read as follows:

(1) The Fire Code official is authorized to render interpretations of this Code and to make and enforce rules and supplemental regulations and to develop Fire Prevention Standards to carry out the application and intent of its provisions.

§ 8.8 FIRE PR EVENTION DIVISION.

(A) § 103.1 of the 2021 International Fire Code is amended to read as follows:

(1) The Fire Code, as adopted and amended, shall be enforced by the Fire Code Official as appointed by the Chief appointing authority of the jurisdiction.

(2) Sections 103.2 through 103.4.1 are deleted.

§ 8.9 FEES.

(A) § 107.1 of the 2021 International Fire Code is added to read as follows:

(1) Fees for inspection, administrative citation, and permits required by the Fire Code shall be established by resolution.

§ 8.10 INSPECTION AUTHORITY.

(A) § 108.1 of the 2021 International Fire Code is added to read as follows:

(1) For the purpose of providing and maintaining functions necessary for the prevention of fire and for the protection of life and property from fire and panic, the Red Bluff Fire Department does establish a self-inspection program, assuring certain occupancies within the city are inspected on a periodic basis for fire safety or at the discretion of the fire code official or their designee.

(2) Failure of the business owner, property owner, or person responsible for the property to comply with the requirement to return the self-inspection worksheet duly completed; or failure to correct the deficiencies noted within 14 days shall result in the issuance of one warning letter extending the inspection period by seven days. Failure to complete and return the self-inspection worksheet shall result in an inspection of the delinquent occupancy by Red Bluff Fire Department personnel, for which the business owner will be charged, as provided in the city schedule of fees and charges for city services.

(3) Further, failure of the business owner, property owner, or person responsible for the property to correct deficiencies found, shall be an infraction; and the city may cause to be issued a citation to the business owner or property owner for violation of the terms of this section.

(4) In addition to any other remedy the city may have, further failure to comply with the requirements of this section could result in the revoking of one's occupancy permit.

(B) Section 109.3 of the 2022 California Fire Code is added to read as follows:

Record Keeping

(1) The fire code official is authorized to prescribe the form and format of such recordkeeping. The fire code official is authorized to require that certain records be filed with the fire code official.

(2) The fire code official authorizes Brycer© to be the official record keeping platform as outlined in the contract between the Red Bluff Fire Department and Brycer©.

§ 8.11 APPE ALS.

(A) § 111.1 of the 2021 International Fire Code is amended to read as follows:

(1) When the Fire Chief or his or her representative disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the code do not apply, or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal the decision of the Fire Chief or his or her representative to the City Council within 30 days from the date of the decision.

§ 8.12 VIOLATIONS AND PENALTIES.

(A) § 112.1 of the 2021 International Fire Code is amended to read as follows:

(1) In addition to any other remedy the city may have, a violation of the fire code, as adopted pursuant to § 8.5, concerning issues of fire retention or fire control; the provisions of the California Building Code concerning issues of fire prevention, fire control, or life safety; any state statute addressing fire prevention or fire control, shall be guilty of an infraction and/or misdemeanor, punished by a fine, up to and including imprisonment, as outlined in § 1.23 of this code.

(2) The imposition of one penalty for any violation shall not excuse the violation or permit it to continue, and all persons shall be required to correct or remedy the violations or defects within a reasonable time.

(3) When not otherwise specified, each seven days that prohibited conditions are maintained shall constitute a separate offense.

§ 8.13 E NFORCEMENT AND CITATION AUTHORITY.

(A) § 112.4.1 of the 2021 International Fire Code is added to read as follows:

(1) The Fire Chief or his or her representative is authorized to issue field citations to any person whenever there is reasonable cause to believe that the person has committed a violation of:

(a) The California or International Fire Code as adopted by § 8.5, and the provisions of this chapter that concern issues of fire prevention or fire control;

(b) Provisions of the California Building Code that concern issues of fire prevention or fire control or life safety;

(c) Any state statute addressing fire prevention or fire control in his or her presence.

(2) Designated officials are authorized to exercise the authority provided by California Penal Code.

§ 8.14 OPEN B URNING, RECREATIONAL FIRES, AND PORTABLE OUTDOOR FIREPLACES.

(A) § 307.1.1 of the 2021 International Fire Code is amended to read as follows:

(1) It is unlawful to burn uncut vegetation or weeds or to permit or cause any open burning of uncut vegetation or weeds.

(2) It is unlawful to start a bonfire or to permit or cause any open burning such as a bonfire unless a special permit is first obtained from the fire code official.

Exception:

  1. Burning conducted in a safe manner meeting the standards set for recreational, portable, or permanent outdoor fireplaces.

(3) Open burning meeting the standard for door/yard burning, including without limitation burn barrels, is expressly prohibited.

Exception:

  1. Fire hazard mitigation work or land clearing may be allowed through a special hazard mitigation permit issued by the fire code official. Open burning of any type is expressly prohibited on paved streets or paved alleys or in the gutters thereof, at any and all times.

(4) The determination of authorized burn days and times shall be the responsibility of the Tehama County Air Quality Control District.

Exception:

  1. Those fire meeting the standards set for recreational, portable, or permanent outdoor fireplaces.

(5) In this connection, the fire code official, air quality control official, or their designee may prohibit all open burning or revoke an active permit when conditions are so hazardous as to justify such prohibition in their judgment.

§ 8.15 FIR E APPARATUS ACCESS ROADS.

(A) § 503.2.1 of the 2021 International Fire Code is amended to read as follows:

(1) Fire apparatus access roads in residential areas, public or private, shall have an unobstructed minimum width of 40', curb-to-curb.

(2) Fire apparatus access roads within multi-family developments shall have an unobstructed minimum width of 30 feet.

(B) § 503.2.3 of the 2021 International Fire Code is amended to read as follows:

(1) Fire apparatus access roads shall be designed and maintained to support minimum imposed loads of 75,000 pounds and shall be surfaced with an AC pavement or equivalent surface to provide all-weather driving capabilities.

(C) § 503.2.4 of the 2021 International Fire Code is amended to read as follows:

(1) The inside turning radius of a fire apparatus access road shall not be less than 30 feet, and an outside turning radius of 45 feet.

(2) Cul-de-sac turning radius shall be 50', or 100' curb-to-curb minimum.

(D) § 503.2.7 of the 2021 International Fire Code is amended to read as follows:

(1) No road or driveway shall have a maximum grade in excess of twelve percent (12%) unless approved by the fire code official, which may require additional fire protection measures. To accommodate unusual access constraints, a road or driveway may include grades up to 15% for distances not exceeding three hundred (300) feet.

§ 8.16 PREMIS ES IDENTIFICATION.

(A) § 505.1 of the 2022 California Fire Code is amended to read as follows:

(1) New buildings and tenant spaces shall have approved illuminated address numbers or building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall be in contrasting color with their background. Address numbers shall be Arabic numerals or alphabetical letters. Where it is impractical to install illuminated numbers due to long driveways or other circumstances, approved reflective numbers with those properties listed above may be installed at the intersection of the driveway and road fronting the parcel.

(2) Numbers for one and two-family dwellings shall be a minimum of 4 inches high with a minimum stroke width of 0.5 inches. Where access is by means of a private road and the building cannot be viewed from the public way, a monument, pole, or other sign or means shall be used to identify the structure.

(3) Numbers for other than one and two-family dwellings shall be a minimum of 12 inches high with a minimum stroke width of 1 inch. Suite numbers for other than one and two-family dwellings shall be a minimum of 6 inches high with a minimum stroke width of 0.5 inches.

Exception:

  1. Addressing of existing properties may continue to maintain previously approved addressing requirements until such point these means are no longer maintained or functional.

  2. These requirements may be modified with the approval of the fire code official.

§ 8.17 FIRE HYDRANTS.

(A) § 507.5.1 of the 2022 California Fire Code is amended to read as follows:

(1) Where a portion of the facility or building hereafter constructed or moved into or within the jurisdiction is more than 250 feet from a hydrant on a fire apparatus access road, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and fire mains shall be provided where required by the fire code official.

Exception:

  1. Residential (R-3) occupancies may be located up to five hundred feet from a fire hydrant if the structure is protected with an approved fire sprinkler system.

(B) § 507.5.1.1 of the 2022 California Fire Code is amended to read as follows:

(1) Buildings equipped with a standpipe system installed in accordance with Section 905 shall have a fire hydrant within fifty (50) feet of a fire department connection (FDC), or as approved by the Fire Code Official.

§ 8.18 FIRE PROTECTION SYSTEMS.

(A) § 901.4.6 of the 2022 California Fire Code is hereby added to read as follows:

(1) An approved fire pump and automatic sprinkler riser room shall be provided in all new buildings, requiring such systems, hereafter constructed.

(2) The construction of an approved fire pump and sprinkler riser room shall be as outlined in Section 901.4.6.

(B) § 901.4.6.1 of the 2022 California Fire Code is amended to read as follows:

(1) Fire pump and automatic sprinkler system riser rooms shall be provided with exterior access door(s) large enough to allow removal of the largest piece of equipment, as approved by the fire code official.

(C) § 903.2.9.1 of the 2022 California Fire Code is amended to read as follows:

(1) An automatic sprinkler system shall be provided throughout all buildings used as repair garages exceeding 3,000 square feet.

(D) § 903.2.21 of the 2022 California Fire Code is added to read as follows:

(1) An automatic sprinkler system shall be provided throughout all buildings and structures requiring a fire flow of two thousand GPM and greater, as determined by Appendix B of the California Fire Code.

Exceptions:

  1. Buildings separated by fire resistive construction (fire barrier/fire walls) as required by the 2019 California Building Code as to create separate fire flow/building areas.

  2. Buildings separated by a minimum of 20 feet can be considered as a separate fire flow area.

(E) § 903.3.1.1.2 of the 2022 California Fire Code is hereby amended to read as follows:

(1) In all group R occupancies, bathroom(s), regardless of size, shall be provided with sprinkler coverage.

(F) § 903.3.1.2 of the 2022 California Fire Code is herby amended to read as follows:

(1) Attic spaces in Group R occupancies exceeding two stories and/or 30 feet in height shall be equipped with sprinkler protection.

(G) § 903.4.2.1 of the 2022 California Fire Code is hereby added to read as follows:

(1) Fire alarm system(s) installed as a dedicated function sprinkler system monitoring alarm(s) shall also provide notification for the purpose of initiating emergency action, including those systems activated solely by the fire sprinkler systems, so that occupants of the building shall be notified audibly within each suite or building division. A minimum of one notification appliance shall be in each suite or building division in an occupied location.

(H) § 903.4.3 of the 2022 California Fire Code is herby added to read as follows:

(1) Approved supervised indicating control valves shall be provided at the point of connection to the riser on each floor in buildings three stories in height and greater.

(I) § 903.6 of the 2022 California Fire Code is amended to read as follows:

(1) In addition to the requirements of Chapter 11, the addition of an automatic sprinkler system to existing buildings shall be retroactively required when in the opinion of the Fire Chief a change of use, occupancy, or character creating a greater hazard to life or property exists, or the required fire flow has increased.

(J) § 905.3.1 #2 of the 2022 California Fire Code is hereby amended to read as follows:

(1) Standpipes shall be installed in buildings three stories or more in height, with approved outlets on each floor above or below grade and the roof.

(K) § 907.6.6 of the 2022 California Fire Code is hereby amended to read as follows:

(1) Combination fire and burglar alarm systems are not permitted.

Exception:

  1. Group R-3 and R-3.1.

§ 8.19 EXIS TING BUILDINGS.

(A) § 1103.5.5 of the 2021 International Fire Code is hereby added to read as follows:

(1) Additions to existing R3 occupancy residential buildings that increase the total square footage by 50% or more of the existing floor area shall meet the requirements for new construction. Additions to all Group R occupancy residential buildings with an existing approved automatic sprinkler system shall be required to extend the sprinkler system into the addition.

(2) Additions to an existing Group R-3 occupancy creating a required a fire flow of more than two thousand GPM as determined by Appendix B of the California Fire Code.

(B) § 1103.5.6 of the 2021 International Fire Code is hereby added to read as follows:

(1) Additions to existing commercial buildings that increase the total square footage of existing floor area by 50% or greater shall meet the requirements for a newly constructed building. All additions to commercial buildings with an existing approved automatic sprinkler system shall be required to extend the sprinklers into the addition.

(2) Additions to an existing commercial building creating a required fire flow of more than two thousand GPM as determined by Appendix B of the California Fire Code.

(C) § 1103.5.7 of the 2021 International Fire Code is hereby added to read as follows:

(1) Additions to existing Group R-1 occupancies that result in additional guest room(s) units shall meet the requirements for a newly constructed building.

(D) § 1103.5.8 of the 2021 International Fire Code is added to read as follows:

(1) For remodels, alterations or repairs to an existing building involving demolition, removal or repair of more than 50% of the existing structure, the building shall meet the automatic fire sprinkler requirements for a newly constructed building. For purposes of this section, the "50%" threshold shall be applied if the project involves any of the following:

(a) The removal, demolition or repair of more than 50% of the exterior weight bearing walls; or

(b) The removal, demolition or repair of more than 50% of the roof structure (including the framing, sheathing, and roof covering of a building but not limited to rafters, trusses, beams, purlins); or

(c) The removal, demolition or repair of more than 50% of the interior tenant improvements on a commercial building which reduces the building to a shell condition.

§ 8.20 FIRE SA FETY DURING CONSTRUCTION AND DEMOLITION.

(A) § 3310.1 of the 2022 California Fire Code is hereby added to read as follows:

(1) Required access roads shall be capable of supporting imposed loads up to 75,000 pounds shall be maintained during all phases of construction.

(2) Buildings under construction shall have approved address numbers, building numbers or approved building identification placed at the entry point of each fire access road.

(B) § 3310.1 of the 2022 California Fire Code is hereby added to read as follows:

(1) Fire hydrant(s) capable of meeting minimum fire flows of 1,000 gallons per minute shall be charged and available to all sites under construction prior to the stacking of combustible materials on site. Fire hydrants shall be located within 500' of the furthest most point of construction; use of an existing hydrant shall not interfere the with daily routine traffic patterns of city residents.

§ 8. 21 VERY HIGH FIRE SEVERITY ZONE DESIGNATION AND CONSTRUCTION STANDARD.

(A) § 4904.3 of the 2022 California Fire Code is hereby added to read as follows:

(1) New structures, including decks and patio covers, located in the very high fire hazard severity zone as designated on the City of Red Bluff Very High Fire Hazard Severity Zone Map and on file in the office of the city building official shall comply with Chapter 7A of the California Building Code and Chapter 49 of the California Fire Code.

§ 8.22 RE GULATIONS FOR FIREWORKS.

(A) § 5601.1.3 of the 2022 California Fire Code is hereby amended to read as follows:

(1) Safe and Sane fireworks, bearing the seal of approval of the State Fire Marshal's Office, are authorized to be sold; provided that a permit is first obtained from the Fire Chief. The Fire Chief may only issue five permits, permitting the sale of fireworks.

(2) The possession, storage, handling, sale, and use of explosives, explosive materials, and fireworks for public displays shall comply with the California Fire Code.

§ 8.23 REFEREN CED STANDARDS.

(A) Chapter 80 of the 2022 California Fire Code is hereby amended as follows:

(1) NFPA 13D-16 Revise Section 8.3.2 as follows: Bathroom(s), regardless of size, shall be provided with sprinkler coverage.

(2) NFPA 13R-16 Revise Section 6.6.2 as follows: Bathroom(s), regardless of size, shall be provided with sprinkler coverage.

§ 8.24 APPENDIX B: FIRE FLOW REQUIREMENTS FOR BUILDINGS.

(A) Table B105.2 of the 2022 California Fire Code is hereby amended to read as follows:

§ 8.25 APPENDI X C: FIRE HYDRANT DISTRIBUTION.

(A) Table C102.1 footnote "f" and "g" of the 2022 California Fire Code are amended to read as follows:

(1) Table C102.1 Footnote f: Fire hydrants shall be located within 50 feet of the FDC, or as approved by the fire code official.

(2) Table C102.1 Footnote g: is deleted.

§ 8.26 APPENDIX D: FIRE APPARATUS ACCESS ROADS.

(A) § D103.2 of Appendix D of the 2021 International Fire Code is amended to read as follows:

(1) Fire apparatus access roads shall not exceed 12 percent in grade.

Exception:

  1. Grades steeper than 12 percent, but not more than 15 percent as approved by the fire code official.

(B) § D103.3 of Appendix D of the 2021 International Fire Code is amended to read as follows:

(1) The minimum turning radius shall be an inner radius of 30 feet and an outer radius of 45 feet.

(C) § D103.4.1 of the 2021 International Fire Code is added to read as follows:

(1) Dead-end fire apparatus access roads in excess of 150 feet shall be provided with width and turnaround provisions in accordance with the local agency requirements for public streets or as approved by local standards.

(D) § D103.6 of the 2021 International Fire Code is amended to read as follows:

(1) Where required by the fire code official, fire apparatus access roads shall be marked with permanent NO PARKING-FIRE LANE signs that meet California Vehicle Code and fire department standards.

(E) § D104.2 of the 2021 International Fire Code is amended to delete the exception and read as follows:

(1) Buildings or facilities having a gross building area of more than 62,000 square feet shall be provided with two separate and approved fire apparatus access roads.

(F) § D106.1 of the 2021 International Fire Code is amended to delete the exception and read as follows:

(1) Multiple-family residential projects having more than 50 dwelling units shall be provided with two separate and approved fire apparatus access roads.

(G) § D106.2 of the 2021 International Fire Code is deleted.

(H) § D107.1 of the 2021 International Fire Code is amended to read as follows:

(1) Projects having more than 50 dwelling units shall be provided with two separate and approved fire apparatus access roads.

(I) § D107.1 exception set forth in the 2021 International Fire Code are deleted.
