9.08.010. - Discharge prohibited.

Except as otherwise provided in this chapter, it shall be unlawful within the boundaries of the city for any person to fire, discharge, shoot or operate or to assist or participate in firing, discharging, shooting or operating any gun, revolver, pistol, firearm, spring gun, air gun, sling, slingshot or device designed or intended to discharge or capable of discharging any dangerous missile or any cartridge, shell, ammunition or device containing any explosive substance designed or intended to be used in or fired from any gun, revolver, pistol or firearm.

9.08.020. - Allowing discharge prohibited.

Except as otherwise provided in this chapter, it shall be unlawful for any person, firm or corporation to cause or permit to be fired, discharged, shot or operated any gun, revolver, pistol, firearm, spring gun, air gun, sling, slingshot or device designed or intended to discharge or capable of discharging any dangerous missile or any cartridge, shell, ammunition or device containing any explosive substance designed or intended to be used in or fired from any gun, revolver, pistol or firearm within the boundaries of the city.

9.08.030. - Minor—Possessing weapons.

Except as otherwise provided in this chapter, it shall be unlawful within the boundaries of the city for any person under the age of 18 years to have in their possession, care, custody or control any gun, revolver, pistol, firearm, spring gun, air gun, sling, slingshot or device designed or intended to discharge or capable of discharging any dangerous missile or any cartridge, shell, ammunition or device containing any explosive substance designed or intended to be used in or fired from any gun, revolver, pistol or firearm.

9.08.040. - Minor—Parent permission.

Nothing in this chapter shall be deemed or construed to prohibit in the city any person under the age of 18 years from having in their possession, care, custody or control any article mentioned in section 9.08.030, in the event that such possession, care, custody or control of such article is had with the consent of the parent or guardian of such person and is under the direct supervision and control of some adult person.

9.08.050. - Agricultural shotgun use—Permit.

A. No shotgun shall be fired to protect agricultural crops without a permit.

B. A person may apply for a permit to discharge a shotgun within the city for the purpose of protecting agricultural crops. No permit shall be valid for more than six months. In order to obtain a permit an application must be submitted to the city manager containing the following:

  1. A statement signed by the agricultural commissioner of the county certifying in writing that the discharge of a shotgun is the only reasonable method of preventing pigeons and other birds from damaging agricultural crops;

  2. A written statement from the sheriff stating that they have been notified in writing of the location in which the proposed firing will take place and the date thereof. The sheriff shall also state any objections that they may have to the proposed activity;

  3. The time and date that a shotgun will be discharged;

  4. The location of the firing;

  5. The reason that the firing of a shotgun is the only reasonable method available to protect agricultural crops;

  6. A statement that the firing will not take place within 150 yards of any residence and/or 100 yards of any public street and/or public facility.

C. Before issuing a permit, the city manager shall determine whether all the provisions of this section have been met and that the safety of the residents of the city is not threatened by the proposed activity.

9.08.060. - Agricultural shotgun use—Time allowed.

No person shall fire a shotgun before 8:00 a.m. and after 6:00 p.m., Monday through Friday, and before 9:00 a.m. and after 6:00 p.m. on Saturday and Sunday. A shotgun must be fired in a safe and responsible manner and shall not be discharged within 150 yards of a residence and/or 100 yards of a public street and/or public facility. Failure to comply with this section shall result in the immediate revocation of the permit.

9.08.070. - Penalty for violation.

The discharge of a firearm in violation of any of the provisions of this chapter shall be a misdemeanor and shall be punishable by a fine of not more than $500.00 and/or imprisonment for not more than six months.
