8.44.010 - Intent.

In order to prevent injury, harm or damage to persons or property from persons using, operating, riding, skating or propelling a skateboard, roller blades, in-line skates, scooter or similar device, certain restrictions concerning such devices are necessary and proper.

8.44.020 - Private property.

A. No person shall use, operate, ride, skate or propel a skateboard, roller blades, in-line skates, scooter or similar device along or over any privately owned property, wall, retaining wall, rail, post, pole, handrail, planter, bench, table, street, alley, other right-of-way, or pedestrian walk/mall situated within a commercial center so as to interfere with pedestrian or vehicular traffic or in a manner which damages or endangers the safety of any other person or property.

B. No person shall use, operate, ride, skate or propel a skateboard, roller blades, in-line skates, scooter or similar device along or over any privately owned property, wall, retaining wall, rail, post, pole, handrail, planter, bench, table, garbage receptacle, street, alley, other right-of-way, or pedestrian walk/mall situated within a commercial center without the consent of the property owner.

8.44.030 - Municipal and public property.

A. No person shall use, operate, ride, skate or propel a skateboard, roller blades, in-line skates, scooter or similar device along or over any city or publicly owned property, sidewalk, pedestrian walk, street, alley or other right-of-way so as to interfere with pedestrian or vehicular traffic or in a manner which damages or endangers the safety of any other person or property.

B. No person shall use, operate, ride, skate or propel a skateboard, roller blades, in-line skates, scooter or similar device along or over any city or publicly owned curb, wall, retaining wall, drainage facility, rail, post, pole, handrail, planter, gazebo, bench, table or garbage receptacle.

C. No person shall use or operate a skateboard, roller blades, in-line skates, scooter or similar device within in area posted to prohibit such conduct.

D. The use of ramps, jumps, walls, rails or any other portable device used to force the skateboard, roller blades, in-line skates, scooter or similar device off the pavement or concrete is prohibited, except within a facility designated for the use of skateboard, roller blades, in-line skates, scooter or similar device where the device and the manner of its use is approved by the facility operator.

E. No person shall be towed on a skateboard, roller blades, in-line skates, scooter or similar device by the use of any mechanical device.

8.44.040 - Signs.

A. Sections 8.44.020(B) and 8.44.030(B) and (C) shall not be enforceable unless and until the owner, manager or other person in charge of the property shall have posted and maintained a sign on the property that prohibits the conduct and references this chapter; provided, however, that the posting of a sign shall not be required for Section 8.44.020(B) to apply to single-family residential property. The letters of the prohibition shall be no less than two inches in height and printed in black with a white background. The citation of the city of Portola Code shall be printed in black letters no less than one inch in height at the bottom of the sign in black with a white background. The sign shall not exceed two hundred forty-four square inches in area.

B. Any sign posted pursuant to subsection A of this section which prohibits skateboarding or skating activities shall be deemed to prohibit skateboarding, roller blading, in-line skating, scootering or similar conduct, unless the sign otherwise provides.

A violation of this chapter is an infraction.
