Chapter 19A — STORM DRAINAGE SYSTEMS

19A-1: DEFINITIONS:

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

CONNECTION: The act of installing and/or constructing any improvement with the purpose of allowing storm water runoff to directly or indirectly enter a storm drainage system from or because of such improvement.

DEVELOPER: Any individual, firm, association, corporation, partnership, trust or other legal entity engaging in development.

DEVELOPMENT: The construction or arranging for the construction of buildings, dwellings or any other improvements or property not previously developed that would increase the storm water runoff.

PRIVATE OR SINGLE PURPOSE STORM DRAINS: Any storm drainage system not within public streets, alleys, easements or property, or which is specifically intended to benefit a specific property and/or development and not the general area as a whole.

REDEVELOPER: Any individual, firm, association, corporation, partnership, trust or other legal entity engaged in redevelopment.

REDEVELOPMENT: The construction or arranging for the construction of buildings or dwellings or additions thereto, or any other improvements on property previously developed that would increase the storm water runoff.

STORM DRAINAGE SYSTEM: Any improvement specifically intended for the conveyance and/or retention of storm water runoff which is located within public streets, alleys, easements or property and which benefits the general area as a whole.

STORM WATER RUNOFF: All that rainwater arriving at and/or originating on the property being developed or redeveloped which by reason of topography, geology or any other obstruction is not retained and which does not infiltrate into the ground within the confines of the property being developed or redeveloped by means or methods considered to be a "storm drainage system" as herein defined.

SUBDIVIDER: The same as defined in chapter 21 of this code.

SUBDIVISION OR DIVISION OF LAND: The same as defined in chapter 21 of this code. (Ord. 1104, 3-15-1977)

19A-2: PERMIT REQUIRED TO CONSTRUCT STORM DRAINAGE SYSTEM:

It shall be unlawful for any person to construct a storm drainage system in a public street, alley, easement or property without first receiving a permit to do so and complying with the provisions of this article. (Ord. 1104, 3-15-1977)

19A-3: PRIVATE OR SINGLE PURPOSE STORM DRAINS:

This chapter is not intended to provide funding for planning, engineering, administration and construction of private or single purpose storm drains which are not within public streets, alleys, easements or property, or which are specifically intended to benefit a specific property and/or development and not the general area as a whole. 19A-4: STORM DRAINAGE SYSTEMS:

This chapter is intended to provide for planning, engineering, administration and construction of storm drainage systems which will be constructed within public streets, alleys, easements or property and which benefit the general area as whole, and are required for the health, safety and welfare of the residents of the city.

Storm drainage systems would include all necessary rights of way, property and improvements specifically intended for the conveyance and/or retention of storm water runoff excluding street improvements, such as curb and gutters, cross gutters, sidewalks, driveways, "V" gutters and paving; and all other improvements not specifically intended for the conveyance and/or retention of storm water runoff unless such improvements are damaged or destroyed because of construction of a storm drainage system then it shall be considered that the repair or replacement of such improvements are part of the storm drainage system.
