1200 - Construction—Provisions governing.

Unless the context hereof clearly otherwise requires, the rules of construction and definitions, hereinafter set forth, shall govern the construction of this Code. The provisions of this Code and all proceedings under it shall be construed with a view to effectuate its objects and to promote justice.

1201 - Headings, effect of.

Article, Chapter, Part and Section headings contained herein shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of this Code.

Whenever in this Code any act or omission is made unlawful, it shall also be unlawful to cause, permit, aid, abet, suffer or conceal such act or omission.

1202 - Acts by deputy.

Wherever a power is granted to, or a duty is imposed upon a public officer or employee the power may be exercised, or the duty may be performed by a deputy of such officer or employee or by a person otherwise duly authorized pursuant to law or ordinance, unless this Code expressly provides otherwise.

1203 - Writing.

Writing includes any form of recorded message capable of comprehension by ordinary visual means. Whenever any notice, report, statement or record is required or authorized by this Code it shall be made in writing in the English language unless it is expressly provided herein to the contrary.

1204 - Reference applies to amendments.

Whenever a reference is made to any portion of this Code, or to any ordinance of this City, the reference shall be deemed to apply to all amendments and additions thereto whenever made.

1205 - Notices.

Whenever notice is required to be given under this Code, such notice shall be in writing, and given (1) by personal service as required of pleadings in civil actions in this State, delivery thereof to the person to be notified or (2) by deposit in the custody of the United States Postal Service or its successor, postage prepaid, addressed to the person to be notified, at his or her last known business or residence address. Service hereunder by mail shall be deemed to have been given two (2) consecutive calendar days following its deposit in the custody of said Postal Service. Personal service shall be deemed given at the time of such personal service.

1206 - Definitions.

(a) Cash Deposits. Wherever this Code requires a cash deposit for any purpose, a valid and sufficient corporate surety bond may be deposited in lieu thereof, if approved by the City Manager.

(b) City. "City" means the City of Port Hueneme.

(c) City Manager. "City Manager" means the duly appointed and acting City Manager of the City or his designee except where declaration is prohibited by law.

(d) Code. "Code" means the Port Hueneme Municipal Code.

(e) Council. "Council" means the duly elected Council of the City of Port Hueneme.

(f) County. "County" means the County of Ventura.

(g) Director. "Director" means the Director of the specific administrative agency of the City.

(h) Fire Chief. "Fire Chief' means the Fire Marshal for the County of Ventura or his authorized deputy.

(i) Gender. The masculine gender includes the feminine and neuter.

(j) Housing Authority. "Housing Authority" means the Port Hueneme Housing Authority.

(k) Oath. "Oath" shall include affirmation.

(1) Office. The use of the title of any officer or employee of the City means the then holder of such office.

(m) Owner. "Owner" as applied to real or personal property, includes all persons having a legal or equitable ownership interest therein.

(n) Person. "Person" as used in this Code includes any natural person, and any legal entity, except the City.

(o) Police Chief. "Police Chief' means the duly appointed and acting Police Chief of the City or his authorized deputy.

(p) Shall, Must and May. "Shall" and "Must" are mandatory and "May" is permissive.

(q) State. "State" means the State of California.

(r) Tenant or Occupant. "Tenant" or "Occupant," as applied to any real or personal property, shall mean and include any person who occupies or possesses such real or personal property, whether alone or with others, and shall include any person who is entitled to such occupancy or possession.

(s) Time. Whenever an act is required to be accomplished within a specified number of days or months, pursuant to this Code, such time period means consecutive calendar days or months, unless otherwise expressly stated.

(t) Redevelopment Agency. Redevelopment Agency means the Port Hueneme Redevelopment Agency.

(u) Resolution. "Resolution" means a resolution duly adopted by the Council.
