Sec. 66-1. - Purpose and intent.¶
It is the intent of this chapter to establish requirements and procedures for licensing taxicabs and vehicles for hire, including non-emergency medical transportation vehicles, providing passenger transportation services within the city.

Sec. 66-2. - Exclusions.¶
This chapter shall not apply to the operation of any vehicle for hire when such vehicle is used for the limited purpose of delivering passengers to places in the city from some point outside the city or merely traveling through the city to reach a destination outside of the city.
This chapter shall not allow for the licensing and/or permitting of an ambulance as a vehicle for hire.

Sec. 66-3. - Definitions.¶
As used in this chapter, the following terms shall have the meanings as set forth below:
Ambulance means a motorized vehicle designed, equipped and maintained for the purpose of transporting sick, injured or incapacitated persons, which is equipped with lights and siren, and is licensed by the California Highway Patrol as an emergency vehicle.
Chief of police means the Chief of the Police Department of the City of Pomona, or his or her designated representative.
City means the City of Pomona, California.
City manager means the City Manager of the City of Pomona, or his or her designated representative.
Driver means every person in actual physical control of driving any vehicle for hire, either as an agent, employee or otherwise.
Driver permit means an identification card issued by the chief of police to each applicant for whom a completed driver permit application has been approved by the city's business license division for the purpose of driving a vehicle for hire within the city. The term "driver permit" includes driver permits issued to taxicab drivers, unless specifically stated herein.
License means a business license issued by the city manager permitting the operation of a vehicle for hire.
Licensee means the operator and holder of a valid business license issued by the city manager permitting a vehicle for hire within the city.
Limousine means every vehicle, the seating capacity of which has been specified by the manufacturer thereof to be seven persons, or more, but does not include a bus, taxicab or non-emergency medical van.
Non-emergency medical transportation means the transportation for hire, except by taxicab, of any passengers who may be ill, incapacitated, infirm or convalescent to or from any office, facility or institution which regularly offers medical care or medical service.
Non-emergency medical van means a vehicle that is used on a commercial enterprise basis to provide medical transportation to a passenger between his or her residence and a health care provider under non-emergency circumstances. A non-emergency medical van shall not include a vehicle that is used to transport patients from one acute care facility to another, who require continuous intravenous medication, medical monitoring or observation by a licensed physician, registered nurse, licensed vocational nurse, licensed paramedic, or licensed emergency medical technician.
Operator means every person who operates any vehicle for hire business within the city.
Operator permit means an identification card issued by the chief of police to each applicant for whom a completed operator permit application has been approved by the Pomona Police Department for the purpose of driving a vehicle for hire within the city.
Permitee means every person who has been issued an operator permit.
Person means and includes persons, firms, corporations, partnerships, joint ventures, joint stock companies and any other form of business organization.
Taxi stand means any public place alongside the curb of a street or elsewhere in the city which has been designated by the city engineer as reserved exclusively for the use of taxicabs.
Taxicab means a vehicle for hire engaged in carrying passengers not over a fixed route, regardless of whether such vehicle is operated for compensation fixed by a taximeter in accordance with the distance traveled or the time elapsed, or both, or by a flat rate schedule not over a fixed route and irrespective of whether the operations extend beyond the boundary lines of the city.
Taxicab driver permit means an identification card issued by the chief of police to each applicant for whom a completed taxicab driver permit application has been approved by the city's business license division for the purpose of driving a taxicab within the city.
Taximeter means a mechanical instrument or device by which the fare charged to a passenger by a vehicle for hire is mechanically registered, calculated or indicated by means of figures in accordance with the distance traveled or the time elapsed or waiting time or both.
Vehicle for hire means any motorized vehicle used for the transportation of passengers over the streets of the city and not over a defined route, regardless of whether such operations extend beyond the boundary limits of the city, at rates per mile, per trip, per hour, per day, per week or per month. For purposes of this chapter, vehicle for hire excludes ambulances.
