Sec. 46-541. - Definitions.¶
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Event means any public exhibition, public gathering, lecturer or lecture; also referred to as "special event."
Exclusive temporary use means that the event will cause one or more of the following circumstances to exist:
(1) The public place and/or right-of-way is temporarily closed to normal pedestrian or vehicular traffic.
(2) Access to the public place and/or right-of-way will be restricted temporarily to participants of the event.
(3) The public place and/or right-of-way is temporarily designated as having a specific private use.
Lecturer means any person or his duly authorized representative who engages in, practices, or conducts, at or within any public place, except when within and in conjunction with a place holding a valid license to operate such business, the avocation, occupation, business or profession of exhibiting, lecturing on, or demonstrating, whether by word of mouth, use of models, samples, charts, slides, still pictures, moving pictures, or in any manner whatsoever, any procedure, process, remedy, promotion, or product, commercial or otherwise, which is purported to be beneficial in any manner whatsoever to mankind or any other living creature.
Public exhibition means any display or showing of works of art, war trophies or war relics, or any display, animate or inanimate, whatsoever, or any boxing exhibition, wrestling match, circus, fair, carnival, road show, public dance, street dance, fiesta parade, concert or entertainment to which the public is admitted or invited, at which an admission fee is charged on admission, through the sale of tickets or in any manner whatsoever, or at which the admission is free of charge.
Public gathering means any celebration, parade, service, or assembly for any purpose whatsoever, in or upon any street, alley, sidewalk, public building, or parkway.
Public place and right-of-way mean any and all publicly owned improvements, including public facilities, streets, sidewalks and alleyways, with the exception of park facilities.

Sec. 46-542. - Penalty.¶
Any person or his duly authorized representative who conducts, operates, manages, stages, or causes, permits or allows to be conducted, operated, managed, or staged in or at any public place any public exhibition, public gathering, lecture, or event, without first having filed an application with the community development director in the manner prescribed in this article and issued a permit therefor is guilty of a misdemeanor. In addition to any penalties imposed by a court of law, there shall be assessed an additional 100 percent of the fixed permit fee for such event, which penalty shall be added thereto and shall be collected therewith from the duly authorized representative and/or person.
