Sec. 1-7.01. - Limitation on claims for payoff of accrued vacation and sick leave…

Any claim based on a County ordinance or resolution for a cash payoff of vacation and sick leave benefits which have accrued prior to September 19, 1985, shall be presented within a ninety-day period commencing on September 19, 1985, or shall be forever barred and extinguished.

Any claim based on a County ordinance or resolution for a cash payoff of vacation and sick leave benefits which accrue on or after September 19, 1985, shall be presented within a ninety-day period commencing with the date of the accrual of the claim or shall be forever barred and extinguished.

Sec. 1-7.02. - Time limits on judicial review petition application.

A petition seeking judicial review of an administrative decision made by the county, its departments and agencies shall be filed not later than the ninetieth date following the date on which the decision becomes final. If there is no provision for reconsideration of the decision in any applicable provision of this Code, the decision is final on the date it is made. If there is such provision for reconsideration, the decision is final for purposes of this section upon the expiration of the period during which such reconsideration can be sought. If reconsideration is sought pursuant to any such provision, the decision is final for the purposes of this section on the date that reconsideration is rejected.

The purpose of this section is to adopt for the county, its departments and agencies, the provisions of California Code or Civil Procedure Section 1094.6.
