Sec. 5-3.01. - Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

Christmas tree shall mean the top or any portion of any evergreen tree severed from the remainder of the tree with the intent that such top or any portion will be used for decorative purposes.

Person shall mean any natural person, whether acting for himself, for any firm or corporation, or for an absent person, except any employee of such natural person while he is working in the presence and under the supervision of such natural person.

Sec. 5-3.02. - Notices of intention to cut: Required.

It shall be unlawful for any person to cut any Christmas tree in the unincorporated territory of the County without having previously filed with the Sheriff a notice of intention to cut Christmas trees.

Sec. 5-3.03. - Notices of intention to cut: Form.

The notice of intention to cut Christmas trees required by the provisions of Section 5-3.02 of this chapter shall be made on a form provided by the Sheriff and shall set forth the following information:

(a) A statement of the approximate number of Christmas trees to be cut, specifying the species;

(b) A description of the land upon which such Christmas trees are to be cut and a description of the land upon which such Christmas trees are to be stored pending shipment;

(c) The dates between which such Christmas trees are to be cut; and

(d) The signature of the person proposing to cut such Christmas trees.

Such notice of intention to cut Christmas trees shall be signed by the owner of the land or by the person having written authority from the owner to sell Christmas trees as the lessee or purchaser of such land.

Sec. 5-3.04. - Christmas tree transportation permits: Required: Form.

It shall be unlawful for any person to transport more than five (5) Christmas trees over any public road within the County without having in his possession a Christmas tree transportation permit containing the following information:

(a) The approximate number of Christmas trees being transported;

(b) The dates during which such transporting is authorized;

(c) The license number, make, and description of the vehicle upon which such Christmas trees are being transported;

(d) The written consent to such transportation dated and signed by the owner or owner's representative of such Christmas trees; and

(e) The written authorization for such transportation of Christmas trees which authorization shall be dated and signed by a Federal forest officer, officer of the Division of Forestry of the State, or peace officer having jurisdiction in the district from which such Christmas trees are to be shipped.

Before transporting such trees from the County, every person transporting any Christmas trees shall have in his possession while so transporting the transportation permit covering such shipment and shall cause such permit to be validated by a Federal forest officer, officer of the Division of Forestry of the State, or peace officer having jurisdiction in the district of the County.

Sec. 5-3.05. - Enforcement.

The provisions of this chapter shall be enforced by all County, State, and Federal peace officers, the Forest Service Officer, the Fire Warden, and the Fish and Game Warden.
