Sec. 5-13.01. - Title.

This chapter shall be known as the "First 5 Plumas County Children and Families Ordinance."

Sec. 5-13.02. - County Commission created.

This chapter shall be known as the "First 5 Plumas County Children and Families Ordinance."

Sec. 5-13.03. - Appointment of the Commission.

The Commission shall be appointed by the Board of Supervisors and shall consist of nine (9) members.

(a) Two (2) members of the Commission shall be from among the County Health Officer and persons responsible for management of the following County functions: children's services, public health services, behavioral health services, social services, and tobacco and substance abuse prevention and treatment services.

(b) One member of the Commission shall be a member of the Board of Supervisors.

(c) Remaining members of the Commission shall be from those persons described as set forth in Health and Safety Code Section 130140(i) (iii).

Sec. 5-13.04. - Commission member compensation.

Members of the Commission shall not be compensated for their services. Members shall be reimbursed for necessary expenses incurred for travel, lodging and childcare, in accordance with the Commission's bylaws and applicable with County policy through a Memorandum of Understanding by and between the Commission and the County of Plumas.

Sec. 5-13.05. - County Strategic Plan.

(a) The Commission shall adopt and annually revise an adequate and complete County Strategic Plan (hereinafter "Plan"), for the support and improvement of early childhood development within the County. The Plan shall be consistent with any regulations or guidelines adopted by the State Children and Families First Commission and state law.

(b) The Plan shall satisfy the County Strategic Plan requirements outlined in Health and Safety Code Section 130140 et seq.

(c) The Commission shall, on at least an annual basis, review its Plan and revise the Plan as may be necessary or appropriate. The Commission shall conduct at least one public hearing before the County Strategic Plan is adopted or amended.

(d) The proposed Plan, and any subsequent revisions to the Plan, shall be submitted to the Board of Supervisors for its approval, prior to submission to the State Commission. The adopted plan, and any revisions, shall be submitted to the State Commission.

(e) The Plan shall meet the requirements outlined in Health and Safety Code Section 130140(a)(1)(C) et seq., including but not limited to the requirements set forth in Section 130140 (a)(1)(C)(iv): The Commission shall measure the outcomes of County funded programs through the use of applicable, reliable indicators and review that information on a periodic basis as part of the public review of its Plan.

Sec. 5-13.06. - Annual audit and report: Public hearing.

The Commission shall prepare an annual independent audit and report in a format prescribed by the State Commission. The Commission shall conduct at least one public hearing prior to adopting its annual audit and report.

Sec. 5-13.07. - Public hearing on State Commission's annual report.

The Commission shall conduct an annual public hearing on the State Commission's annual report.

Sec. 5-13.08. - Local Children and Families First Trust Fund.

The Board of Supervisors hereby authorizes the establishment of a local Children and Families First Trust Fund, (hereinafter "Trust Fund"), pursuant to Section 130105 of the Health and Safety Code.

(a) Moneys deposited into the Trust Fund shall be used only for purposes authorized by Proposition 10 in accordance with the Plan approved by the Commission.

(b) Moneys deposited into the Trust Fund shall be expended by the Commission.

Sec. 5-13.09. - Annual budget.

The Commission shall adopt an annual budget and conduct a public hearing prior to adoption of the proposed budget.

Sec. 5-13.10. - Conflict of interest.

The Commission shall adopt a policy, consistent with state and local law, on conflict of interests of its Commission members.

Sec. 5-13.11. - Appointment of commissioners.

Commissioners shall be selected by the Board of Supervisors, who may establish a subcommittee to accomplish this task if desired. Appointment may occur by majority vote of the Board. Likewise, the Board may remove any member appointed to the Commission by a majority vote. Each commissioner shall serve a term of three (3) years. Commissioners are not limited to the number of terms they may serve on the Commission.

In its bylaws, the Commission may establish recommendations for the Board of Supervisors to consider regarding the manner of appointment, selection and removal of members of the Commission, the duration and number of terms Commission members shall serve, and any other matters that the Commission deems necessary for the governance of the Commission.
