3-6-1: FIREWORKS PROHIBITED:¶
The sale or discharge of firecrackers, salutes and other explosive articles of similar nature within the city is hereby prohibited and it shall be unlawful for any person to sell, offer for sale or discharge any firecrackers, sparklers, roman candles and other explosive articles of similar nature within the city. Exception: The provisions of this section shall not apply to any person engaged in the preparation for or performance of a public fireworks display authorized by written order of the city council in advance, in full compliance with the conditions or restrictions contained in such order. 3-6-2: BLASTING WITH EXPLOSIVES; PERMIT:¶
It shall be unlawful for any person to do any blasting within the city limits or to set off, fire, discharge, or explode any dynamite, powder, nitroglycerin, or any other explosive, or explosive substance or combustible device or material, without first obtaining written permission therefor from the fire chief, and then only under such terms and conditions which will preclude the possibility of injury to persons or property because of the blasting or the use of explosives or combustible devices or materials; provided further, that such blasting or use of explosives or combustible materials or devices may be done or carried on only under the terms of the permit and under the terms of this chapter, and under the written permission of the fire chief. All blasting and use of explosives shall be conducted or carried on by the use of a screen, blanket, or other device which shall successfully hold all debris and waste material as near the ground as possible and shall prevent the waste material and debris from being forced, propelled, or shot into the air, and it shall be unlawful for any person to do any blasting or to use any explosive or explosive material or device whether under written permission of the fire chief or otherwise, without the use of a blanket, screen, or covering. The fire chief will give adequate notice to the police chief of the issuance of all blasting permits.
The fire chief is hereby given power to regulate the use of explosives within the city and is given the power to limit or regulate the size of charges or shots in all cases of blasting for construction work, or otherwise, and it shall be the duty of the fire chief whenever application is made to him for permission to use an explosive or to do blasting within the city, to investigate the place where the work is proposed to be carried on, and to impose such terms or conditions upon the use of all explosives or combustible materials or substances and all dynamite or powder which will preclude the possibility of injury to persons or property because of the use; and it shall be the duty of the fire chief when written permission for the use is given, to state the terms and conditions under which the permission is given. Each permit shall require that the permittee notify emergency dispatch (by telephoning 911) within one hour prior to conducting any blasting operation of the time and place of such blasting.
