2-7-1: ESTABLISHING BOARD:¶
There is hereby established a building board of appeals consisting of five (5) members and one alternate member who are qualified by experience and training to pass upon matters pertaining to building construction. (Ord. 1642, 6-14-2011)
2-7-2: DUTIES OF THE BOARD:¶
The duties of the board shall be to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of the state codes. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply or an equally good or better form of construction is proposed. The board shall have no authority to waive requirements of the state codes. (Ord. 1642, 6-14-2011)
2-7-3: MEMBERS:¶
The members of the building board of appeals shall be appointed by the mayor and shall receive the approval of the majority of the city council. The initial terms shall be one member for two (2) years, two (2) members for three (3) years, and two (2) members for four (4) years; and thereafter each member shall be appointed for a four (4) year term. The alternate member shall be appointed for a four (4) year term. Vacancies shall be filled for the unexpired term of the member affected. (Ord. 1528, 9-26-1995; amd. Ord. 1642, 6-14-2011)
2-7-4: OFFICERS:¶
The building board of appeals shall meet in regular sessions and elect from their members a chairman and vice chairman. Their duties shall respectively be such as are usually carried by such officers. Officers shall hold office for one year, or until their successors are elected. The building official and the fire chief shall be ex officio members and the building official shall act as secretary of the board. The board shall adopt rules necessary to the conduct of its affairs and shall keep minutes of its proceedings. The meetings of the board shall be held at the call of the chairman and at such other times as the board may determine. (Ord. 1226, 6-10-1980; amd. Ord. 1642, 6-14-2011)
2-7-5: APPEALS TO BOARD:¶
Appeals shall be filed with the secretary to the board within ten (10) days of the written decision of the building official. A fee to defray the costs incidental to conducting the proceedings of the board shall be collected at the time of filing. Refer to the development service department's master fee schedule. 2-7-6: HEARINGS ON APPEALS:¶
The board shall have a hearing on any appeal within twenty (20) days from the date the appeal is filed with the secretary of the board. The board shall render its decision and finding in writing to the appellant, building official and fire chief within thirty (30) days from the date the appeal is filed with the secretary. 2-7-7: DECISION OF THE BOARD:¶
The decision of the building board of appeals shall be final. (Ord. 1226, 6-10-1980; amd. Ord. 1642, 6-14-2011)
