6-16-1: APPLICABILITY OF CHAPTER:¶
No portion of this chapter shall prohibit the possession of any firearm, or any ordinary air rifle or pellet gun, or any ammunition for such weapons if carried pursuant to a valid permit issued by a duly authorized government agency or lawfully carried for purposes of gun safety training, hunting, fishing or other lawful sport. 6-16-2: CHAPTER SUPPLEMENTAL TO STATE LAW:¶
The purpose in passing this chapter is to supplement state law regulating and controlling deadly weapons, Penal Code, section 12000, et seq. (Ord. 1490, 4-14-1992)
6-16-3: DISCHARGE OF FIREARMS:¶
It shall be unlawful in the city to fire, discharge, shoot or operate, or to assist or participate in the firing, discharging, shooting or operating of any gun, revolver, pistol, firearm, spring gun, air gun, sling, slingshot, or device designed or intended to discharge or capable of discharging any dangerous missile or any cartridge shell, ammunition or device containing any explosive substance devised or intended to be used or fired from any gun, revolver, pistol or firearm, except when it may be necessary to do so to protect life or property, or to destroy or kill any predatory or dangerous animal, or in the hunting of game with a shotgun within the boundaries of a hunting or game club or game farm and the pellets discharged from such shotgun do not exceed the size of no. 2 shot; or in the enforcement of any law by any peace officer, and except when used at any pistol or rifle range in accordance with rules and regulations approved by the police department and the city council in connection with the operation of such pistol or rifle range. 6-16-4: CONFISCATION AND DESTRUCTION:¶
Any dangerous or deadly weapon possessed or controlled in violation of the California Penal Code by any person shall be confiscated by the chief of police and upon a plea of guilty or upon the conviction thereof in the case of an adult or upon the findings of the allegation to be true in the case of a juvenile, shall be destroyed by the chief of police after such plea, after judgment of conviction becomes final, or after the allegations are found to be true. 6-16-5: EXEMPTION:¶
The provisions of this chapter shall not apply to the discharge of a firearm using blank ammunition in the course of a skit or theatrical presentation, whether indoors or outdoors, provided that said firearm and blank ammunition which is to be used in the skit or theatrical presentation is inspected and approved prior to its use by the chief of police of the city or his appointed designee and, in the event of a case of a continuing performance, the firearm and ammunition must be inspected prior to the initial performance only. In the case of a continuing performance, only the firearm and blank ammunition inspected by the chief of police of the city or his appointed designee shall be used in such performance.
