9.16.010 Definition.¶
"Dangerous or deadly weapon," as used in this chapter, includes, but is not limited to, any revolver, pistol, shotgun, rifle, or firearm, which may be used for the explosion of cartridges, and any airgun, B-B gun, gas-operated gun, spring gun, slingshot, bow and arrow, and any weapon or device designed to project a missile of any type with such force or velocity as to be unsafe or dangerous to any person or property, in the city, other than:
A. Carried pursuant to valid permit issued by duly authorized governmental authority; or
B. Any ordinary rifle or shotgun lawfully owned or possessed in a domicile, or while being conveyed to or from such domicile for the purpose of hunting or other legitimate use outside of the city. (Prior code § 9.84.010)
9.16.020 Discharge unlawful.¶
It is unlawful for any person, except in self-defense, to fire, discharge, or cause to be emitted any projectile or missile from any dangerous or deadly weapon in the city. This section does not apply to any police officer or member of the armed forces of the United States in the discharge of his duty, or to the discharge of any authorized target rifle in a shooting gallery operated, conducted and licensed, pursuant to the ordinances of the city, or to any bow and arrow used as a part of any authorized school or recreational program under supervision of duly authorized instructors. 9.16.030 Carrying knives or daggers in plain view prohibited.¶
A. As used in this section, "knife" or "dagger" includes any knife, dirk or dagger having a blade three inches or more in length, any pick or similar sharp tool, any straight-edge razor or any razor blade fitted to a handle.
B. No person shall wear or carry in plain view any knife or dagger upon any public street or other public place or in any place open to the public.
C. The prohibitions of this section shall not apply where a person is wearing or carrying a knife or dagger for use in a lawful occupation, for lawful recreational purposes, or as a recognized religious practice, or while the person is traveling to or returning from participation in such activity. 9.16.040 Possession by minor unlawful.¶
It is unlawful for any person under the age of eighteen years to possess, except in his or her domicile, or while being conveyed to or from such domicile for the purpose of hunting or other legitimate use outside of the city, any dangerous or deadly weapon. (Prior code § 9.84.030)
9.16.050 Possession--Fighting unlawful.¶
It is unlawful for any person who has in his immediate physical possession any dangerous or deadly weapon, to engage in any fight or participate in any other rough or disorderly conduct in the city. (Prior code § 9.84.040)
9.16.060 Possession—Loitering unlawful.¶
It is unlawful for any person who has upon his person or in his possession any dangerous or deadly weapon, to loiter or be about any place where intoxicating liquors are sold or any other place or public resort. (Prior code § 9.84.050)
9.16.070 Confiscation by police.¶
Any weapon used or possessed in violation of the provisions of this chapter is declared to be a nuisance, and the same shall be taken from the person violating this chapter and surrendered to the chief of police, and shall be destroyed or otherwise disposed of as provided by the provisions of Section 12028 of the Penal Code of the state. 9.16.080 Violation—Penalty.¶
Every person violating any provision of this chapter shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than five hundred dollars or by imprisonment for not more than six months, or by both such fine and imprisonment. (Prior code § 9.84.070)
