Pismo Beach Municipal Code Ch. 1.06 City Insignia

This chapter is established in order to prevent the unauthorized use of the city seal, city logo, or any other city insignia, thereby protecting the city's identity and brand, and to avoid confusion regarding official communications from the city to the general public.

For purposes of this chapter the words and phrases defined in this section mean as follows:

A. "City insignia" shall mean all seal(s), logo(s), or other official insignia of the City of Pismo Beach enumerated and particularly identified in administrative rules and regulations adopted from time to time by the City Manager.

B. "City logo" shall mean the standard brand insignia of the City of Pismo Beach used to publicly convey the identity, authority, or endorsement of the city government, as adopted by the City Council and particularly identified in administrative rules and regulations adopted from time to time by the City Manager.

C. "City seal" shall mean the legal, corporate insignia of the City of Pismo Beach, as more particularly identified in administrative rules and regulations adopted from time to time by the City Manager.

It is unlawful for any person to make or use the city seal, the city logo, any city insignia, or any facsimile or reproduction thereof, or make or use any design, symbol, emblem, insignia, or similar device that is an imitation of any city insignia, or that may be mistaken therefor, that is designed, intended, or likely to confuse, deceive, or mislead the public, for private or commercial purposes, or for any purpose other than for the official business of the city, its City Council, officers or departments, without the express consent of the City Manager or designees under the authority granted by the City Council.

The City Manager, or designee, shall have the authority to establish administrative rules and regulations consistent with the provisions of this chapter for the purpose of interpreting, clarifying, carrying out, furthering, and enforcing the requirements and the provisions of this chapter. In particular, the City Manager, or designee, will adopt, from time to time, an administrative policy setting forth the particular forms of all official city insignia, along with technical guidelines for, and limitations on, the use thereof. All insignia specifically enumerated in such administrative regulation shall be considered city insignia as referred to herein. A copy of such administrative regulation shall be on file in the office of the City Clerk.

Any violation of this chapter shall be a misdemeanor and shall be punishable as set forth in Pismo Beach Municipal Code Section 1.20.010.
