5.44.010 PERMIT – REQUIRED.

It is unlawful for any person to open, conduct, or carry on or to participate in the opening, conducting, or carrying on of a hall or place where public dances are held, or a public dance, in the city of Pinole, county of Contra Costa, state of California unless there exists a valid permit therefor granted and existing in compliance with the provisions of this chapter. (Ord. 253 § 1, 1968).

5.44.020 PERMIT – APPLICATION.

Applications for a permit to open, conduct, or carry on a dance hall or a public dance shall be made in writing to the chief of police of forms furnished and approved by the chief of police. Applications must be made at least ten days prior to the opening of any public dance or dancehall. (Ord. 253 § 2, 1968).

5.44.030 PERMIT – INVESTIGATION – PERMIT.

Upon receipt of an application for a permit to open conduct or carry on a dance or public dance the chief of police shall make or cause to be made such investigation of the applicant and the premises proposed to be used for a dance hall or for a public dance and all other matters contained in the application as the chief of police shall consider necessary to protect the health, safety, morals or welfare of the public, and to assure that any public dance or dance authorized by the permit applied for will be conducted and operated in compliance with all applicable laws of the state of California and regulations of the city of Pinole. The chief of police shall issue a permit or shall deny the application therefor. (Ord. 253 § 3, 1968).

5.44.040 PERMIT – REVOCATION.

The chief of police may revoke any permit issued under this chapter for violation of any of the terms, conditions, regulations or provisions of this chapter, or of the laws of the state of

California or of the city of Pinole, or if the use or exercise of such permit would be detrimental to the health, safety, morals or welfare of the public. (Ord. 253 § 4, 1968).

5.44.050 PERMIT – NONTRANSFERABLE.

Any permit issued pursuant to this chapter shall be for a specific dance to be held on a specific date and at a specific place. Permits issued pursuant to this chapter shall not be transferable. (Ord. 253 § 6, 1968).

5.44.060 APPEAL UPON DENIAL OF APPLICATION.

Upon denial of the application by the chief of police the applicant may file an appeal upon the application with the City Council of the city of Pinole within five days from and after the notice of denial of the application by the chief of police. (Ord. 253 § 7, 1968).

5.44.080 MARATHON DANCES PROHIBITED.

It is unlawful for any person to conduct, operate or carry on within the city of Pinole any marathon dance, marathon walk, or public dance where persons are employed to dance with patrons of such dance, either for a fixed compensation or for a percentage of the fee or charge made to patrons. (Ord. 253 § 5, 1968).
