§ 8.32.010. Cover, fence and gate requirements.¶
A. Every person in possession of land within the city, either as owner, purchaser under contract or otherwise, fee holder, lessee, tenant or licensee, upon which there is situated any man-made excavation, including, but not intended to exclude, other man-made excavations thereby, oil-well sumps, quarries, ditches or mines, where such man-made excavation is three feet or more in depth, shall either cover it or shall erect a fence or other solid structure not less than five feet in height above the underlying ground, with no opening therein, other than doors or gates, larger than three inches square.
B. This section shall not apply to any man-made excavation during the course of the construction of the same, where the same is being excavated in accordance with a permit issued for that purpose or a related purpose under any other chapter of this code, provided the provisions of such permit and said chapter are fully complied with at all times.
