§ 12.12.340. Billing of costs.

The city engineer shall bill the permittee or deduct from the deposit made or maintained by the permittee for all fees and costs chargeable under Division I and Chapters 12.36 and 12.40 of this title.

§ 12.12.350. Billing of issuance fees.

At the request of a permittee who maintains with the city engineer adequate security as provided in Division I and Chapters 12.36 and 12.40, and to whom ten or more permits have been issued monthly for three consecutive months, the city engineer may waive the requirement covering prepayment of the issuance fees and bill the permittee for issuance fees covering permits issued subsequent to such request. The city engineer may revoke such waiver at any time.

§ 12.12.360. Additional repairs—Payment requirements.

If at any time subsequent to the first repair of a surface of a street damaged or destroyed by any excavation, encroachment or moving operation in such street, it becomes necessary again to repair such surface due to settlement or any other cause directly attributable to such excavation, encroachment or moving operation, the permittee shall pay to the city engineer the cost of such additional repair; provided, however, that the city engineer shall have the option of either making the repair or requiring the permittee to make the repair.

§ 12.12.370. Failure to pay—Deduction from deposit.

If, within thirty days after a bill has been sent, the permittee does not pay the same in full, such amount may be deducted from his or her general deposit, or the city engineer may recover the amount due from any security the permittee has filed under Division I and Chapters 12.36 and 12.40. If the deposit or security is insufficient to pay the amount due, the city may enforce collection by legal means.

§ 12.12.380. Failure to pay—Holding of deposits.

The city engineer may elect not to issue further permits to the permittee, and may hold any deposits, guarantees or bonds of the permittee, as long as any bill remains unpaid.
