18.04.010 Prohibited distribution of printed material or writings on private¶
property contrary to notice.
It is unlawful for any person to throw; cast; scatter; deposit; a>x; attach; place; paint; post; stick; stamp; or
otherwise distribute printed material or writings of any kind; including newspapers; in or upon any fence; or other
structure or =xture; lawn; mailbox; or other place upon private property after the owner or occupant of such
private property has given notice to the distributor of such material that such distribution is prohibited.
Notice of the prohibited distribution of such printed material or writings may be given by the owner or occupant of
the private property; by personal request to the distributor; by written notice personally delivered or mailed to the
distributor; or by posting a notice bearing the words "No Trespassing;" No Handbills;" "No Printed Material;" "No
Solicitors" or substantially similar words; in a conspicuous place on the property where it can be easily read by a
person of normal visual acuity from the street adjoining the front entrance to the property. (Ord. 1985 NCS §2,

18.04.020 Prohibited distribution of printed material or writings on private¶
property, where material not secured.
Notwithstanding Section 18.04.010; it is unlawful for any person to throw; cast; scatter; deposit; a>x; attach; place;
post; stick; or otherwise distribute printed material or writings of any kind; including newspapers; in or upon any
structure; lawn; mailbox; or other place upon private property without securing; weighting down; or otherwise
preventing such printed material or writings from being blown or drifted about such private property or upon

18.04.030 Prohibited distribution of printed material or writings on public¶
property.
No person shall throw; cast; scatter; deposit; a>x; attach; place; paint; post; stick; stamp; or otherwise distribute
printed material or writings of any kind in or upon any public sidewalk or curb; public street; or any other public
building; public place; or public property; or in or upon any lamppost; pole; tra>c sign; fence; or other structure or
=xture; or tree or shrub; located in or on any public property; or in or upon any vehicle parked on a public street
or in any public parking lot; provided; that it shall not be unlawful to hand out such material to any person who is
willing to accept it; and it shall not be unlawful to leave such material in any public place that is designated by the

18.04.040 Reserved.¶
18.04.050 Removal, destruction or defacing signs prohibited.¶
It is unlawful for any person to deface, destroy or move any advertising signs erected in compliance with the
provisions of any provision of this code or other ordinance of the city. (Ord. 46 CS §15; prior code §3.5.)
18.04.060 O7ensive displays prohibited.¶
It is unlawful for any person to display for advertising purposes upon any billboards or advertising signboards; or
upon or in any window; or upon any building or fence; or in any public place; any delineation of any nude human
=gure; or any other matter or thing of an indecent or immoral nature; or shocking or o?ensive to the moral sense.

18.04.070 Responsibility for illegally posted advertising material.¶
A. It is unlawful for the sponsor of an event or the owners or lessees of a place mentioned in advertising
material or displays to himself post or distribute; or to permit; encourage or otherwise direct another person to
post or distribute an advertisement or display in violation of this chapter; and such owners; sponsors or lessees
shall have an a>rmative duty to prevent such illegal posting or distribution by any person connected with such
event or place.
B. Whenever a sponsor; owner or lessee is prosecuted for a violation pursuant to the provisions of this section;
the court may; on the request of the sponsor; owner or lessee, take appropriate steps to make the person or
persons responsible for the illegal posting or distribution or directing the same; a codefendant.
C. In the event such codefendant is held solely responsible and found guilty, the court may dismiss the charge
against the sponsor; owner or lessee.

18.04.080 Exemptions.¶
The provisions of Section 18.04.010, 18.04.020, and 18.04.030 shall not apply to:
A. The distribution of United States mail; telegrams; or other printed materials; or writings; pursuant to any state
or federal law which preempts local regulations.
B. The posting of any legally required o>cial notices by any public agency or o>cer; including notices by city of
Petaluma planning department; building division; police department; =re department; or other city of Petaluma
o>cial.
C. The distribution of any materials for which owner or occupant has subscribed or given prior approval.
