14.32.010 Public utility deBned.

"Public utility," wherever used in this chapter, means and includes any person engaged in the business in the city

of delivering, furnishing or supplying heat, light, gas, power, electricity, steam, water, telephone or telegraph

service, railway or transportation service, or any other kindred public service to the city or the inhabitants thereof.

14.32.020 Map of underground works required.

Every public utility engaged in the business of delivering, furnishing or supplying to the city, or the inhabitants

thereof, any of the services mentioned in Section 14.32.010 at the time of the Jnal passage of the ordinance

codiJed in this chapter shall Jle in an oLce maintained by it in the city, or in the oLce of the city clerk, a complete,

detailed map or plat of all of the underground pipes, conduits, or other underground works, owned or controlled

by, or constituting the underground system of such public utility, showing and designating thereon, clearly, the

exact location of such pipes, conduits or other underground works under any street, alley, lane, gutter or sidewalk

in the city, the size or dimensions thereof, and also the depth thereof below the surface of such street, alley, lane,

gutter or sidewalk; provided, however, that in addition thereto any public utility engaged in the business of

furnishing, delivering or supplying water to the city and the inhabitants thereof shall also show upon such map the

date of the installation of its underground pipes and also the kind of material thereof.

Any public utility which shall after the Jnal passage of the ordinance codiJed in this chapter commence or begin to

engage in the business of public utility in the city shall, on the Jrst day of January or the Jrst day of July, whichever

comes Jrst after the commencement of such business, Jle the required map or plat and shall thereafter comply

with each and all of the requirements of this chapter. (Ord. 114 NCS §§2, 4; prior code §21.10.)

14.32.030 Filing supplemental maps.

Every public utility engaged in business in the city which shall, after the Jling of the map or plat provided for in

Section 14.32.020, extend or add to, take away from or reduce its underground system or works herein

mentioned, shall, on the Jrst day of January and the Jrst day of July of each year after the Jling of the original map

or plat, Jle in an oLce maintained by it in the city or with the city clerk, an additional or supplemental map or plat

showing such changes, in the particulars required by Section 14.32.020. The replacement of an existing

underground pipe, conduit or other underground work shall not be deemed a change within the meaning of this

14.32.040 Location of underground work.

It shall be the duty of the director of public works to designate the location of any underground pipe, conduit or

other underground work, and any violation by a public utility as to the location of the underground pipe, conduit

or other underground work as designated by the director of public works shall be deemed a violation of this
