Chapter 2.30 — PUBLIC SAFETY COMMISSION

A public safety commission is established in and for the city.

The public safety commission shall consist of seven members.

Members of the public safety commission may only be appointed by majority vote of the council. All members of the public safety commission shall have the following minimum qualifications: members shall be:

(1)

Citizens of the United States;

(2)

At least 21 years of age; and

(3)

Residents of the city at the time they apply and during their term of service on the commission;

Provided, however, that one member may be a nonresident of the city so long as that individual lives within the unincorporated areas of the county that are within the outlying boundaries of the city and the nonresidential commissioner understands that the purpose of the commission is to advise the city council on matters affecting the city only. City employees may not serve as members of the public safety commission.

Commissioners shall be compensated $100.00 per regular meeting attended, not to exceed a total of $200.00 per month. Compensation shall commence upon appointment to the commission.

(a)

The terms of office for members of the public safety commission shall be four years or until their successors shall be appointed and qualified.

The initial terms of the commission shall be staggered, with four commissioners serving three-year terms and three commissioners serving one-year terms.

Vacancies for any unexpired term of membership in the public safety commission shall be filled by appointment by the council as provided by section 2.30.030. Prior to filling any vacancy, the vacancy shall be advertised pursuant to the terms of the Maddy Act.

Any member of the public safety commission may be removed without cause by a majority vote of the members of the council. Any member of the commission may be removed upon missing three consecutive meetings without an excused absence.

The public safety commission shall select one of its members as chairperson of the commission and one as chairperson pro tempore. The chairperson and chairperson pro tempore shall hold office for a term of

one year. In case of the absence of the chairperson, the chairperson pro tempore shall conduct the meeting. Should both officers be absent, the members then present shall select one of their numbers to serve as chairperson pro tempore.

(a)

The public safety commission shall meet at least once a month at such time and place as it may fix by resolution.

(b)

Meetings shall be open to the public, and the commission shall comply with the Ralph M. Brown Act, Government Code section 54950 et seq. Special meetings may be called in accordance with the Ralph M. Brown Act.

Four members of the public safety commission shall constitute a quorum, but a lesser number may adjourn from time to time.

The public safety commission shall cause a record to be kept of all of its proceedings, and for that purpose may select one of its members as secretary. The city manager or his designee shall provide such stenographic assistance as is necessary in keeping the records of the proceedings.

(a)

The public safety commission shall have the power, and it shall be the duty of the commission, to advise and/or make recommendations to the city council and the city manager on matters pertaining to the operation, maintenance, use and management of crime, fire, traffic and animal control programs and such other public safety issues as may be requested for submission to the commission by the city council and city manager.

The public safety commission shall perform such other duties as may be imposed upon it by the city council by ordinance or resolution.

(c)

The public safety commission shall have the authority by resolution to adopt rules and procedures in accordance with state law.

(a)

The city manager shall render cooperation and all reasonable and necessary assistance to the public safety commission.

(b)

Neither the commission nor any person connected to the commission shall incur any financial liability in the name of the city.
