Chapter 18.04 — GENERAL PROVISIONS

Sec. 18.04.010. - Citation and authority.

This title is adopted to supplement and implement the State Subdivision Map Act and may be cited as the "Subdivision Ordinance of the City of Perris." References herein to this title shall refer to the subdivision ordinance of the city.

Sec. 18.04.020. - Definitions.

The following words, terms and phrases, when used in this title, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

City means the City of Perris.

City engineer means the city engineer or the employee of the city performing the duties of the city engineer.

Commission means the Planning Commission of the City of Perris.

Council means the city council of the City of Perris.

Director means the Director of Development Services of Development Services or their designee.

General plan means the general plan of the city and all the elements thereof as authorized and defined in the Government Code commencing with section 65300.

Owner includes the plural and means any and all persons whose consent is necessary to the filing of a subdivision map and to the making of the dedications of land or other properties shown thereon and to passing clear title thereto.

Subdivision, subdivider, parcel map, tentative map, final map, improvement and design have the same meanings respectively, as those terms are defined or used in division 2 of title 7 of the Government Code of the state, known as the Subdivision Map Act.

Sec. 18.04.030. - Reserved.

Sec. 18.04.040. - Tentative and final maps.

A tentative and final map shall be required for all subdivisions creating five or more parcels, five or more condominiums as defined in section 783 of the Civil Code, a community apartment project containing five or more parcels, or for the conversion of a dwelling to a stock cooperative containing five or more dwelling units, except where:

(1)

The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway, and no dedications or improvements are required by the legislative body;

(2)

Each parcel created by the division has a gross area of 20 acres or more and has an approved access to a maintained public street or highway;

(3)

The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of a tract of land zoned for industrial or commercial development, and which has the approval of the governing body as to the street alignments and widths; or

(4)

Each parcel created by the division has a gross area of not less than 40 acres or is not less than onequarter of a quarter-section.

Sec. 18.04.050. - Parcel maps.

A parcel map shall be required for those subdivisions described in section 18.04.040(1) through (4), and for subdivisions of four parcels or less, except as provided by section 18.16.040; provided a parcel map shall not be required for subdivisions created by short-term leases (terminable by either party on not more than 30 days' notice in writing) of a portion of an operating right-of-way of a railroad corporation defined as such by section 230 of the Public Utilities Code; or for land conveyed to or from a governmental agency, public entity or public utility, or to a subsidiary of a public utility for conveyance to such public utility for rights-ofway; further provided, however, that upon a showing made to the city council based upon substantial evidence that public policy necessitates such a map, this exception shall not apply.
