Chapter 5.16 — TELEVISION ANTENNA ERECTION

Before any person shall engage in the business of erecting television antennas in the city he shall first procure from the city a license so to do, and pay the license tax imposed on such business and must register his name in a book provided for that purpose at the office of the city clerk, giving full name, residence and place of business, and in case of removal from one place to another in the city, shall make corresponding change in the register accordingly and file therewith his affidavit that such name and place of business as registered are correctly stated.

A television antenna erection license shall be issued by the city on payment of an annual fee of fifteen dollars or a semiannual fee of ten dollars. (Ord. 121 § 1, 1954)

Before the aforesaid license shall be issued every person intending to engage in the business of television antenna erection shall first obtain and file with the city clerk after approval has been made by the city attorney, a surety bond in the penal sum of one thousand dollars guaranteeing compliance with all and every provision of this chapter pertaining to television antenna erection, payable to the city or to any person aggrieved by any act or violation of any term or terms of this chapter, and the person shall have a right of action on the bond for the recovery of money or damages, or both. It shall be the duty of the licensee to renew such bonds upon the expiration of the term for which they may be given; and a failure on the part of any such person to renew any such bond immediately upon the expiration of such term shall have the same effect as if no bond had been given.

Nothing contained herein shall be construed to limit the liability of the amount named as the penalty therein, either to any person injured or to the city. No person shall engage in the business of performing television antenna erection in the city until he shall have obtained a license from the city and given an acceptable bond to the city as herein set forth, and has been registered on the books of the city clerk.

All license taxes hereinbefore prescribed in Section 5.16.010 shall be for the calendar year or half year or any fraction of the period payable in advance to the city clerk. The cost of a license for a fraction of a year shall be the same as one for one-half year. The license shall be in lieu of other license charges under the general license ordinance codified in Chapter 5.04 on account of doing a television antenna erection business in the city. Any person regularly licensed and registered as hereinafter provided, who shall lend his license or registration to any person or shall take out any permit to do television antenna erection work pursuant to the provisions of this chapter and shall allow any person not regularly licensed and registered to do any television antenna erection work under the permit shall in addition to, and irrespective of, any other penalty imposed, have his license revoked and registration canceled by the city council.

It shall be the duty of the electrical inspector to prefer charges with the city council against any person violating the provisions of this chapter. The city council may, after a fair and impartial hearing, revoke such person's license.

The electrical inspector may issue to any individual an owner's special permit authorizing the individual to install television antennas on or about a building of which the individual is owner, provided that no television antenna erection authorized under any such owner's special permit shall be done, nor shall the owner holding the permit allow any such work to be done, except personally by the owner to whom the permit is issued, and if this or any other provision thereof shall be violated by the holder of such owner's special permit such permit shall be subject to immediate cancellation by the electrical inspector, and the holder thereof shall be liable to the penalty provided for violations of this chapter.

No person, firm or corporation shall erect a television antenna mast or tower or add to or replace the guy lines and fastenings on an existing mast without first obtaining a permit from the electrical inspector.

• A. Before a permit is issued a permit fee of one dollar shall be paid to the electrical inspector.

• B. A reinspection fee of one dollar shall be made for each trip when extra inspections are necessary due to any of the following reasons:

  1. Wrong address on permit;

  2. Condemned work resulting from faulty construction;

  3. Repairs or corrections not made when inspection is called;

4. Work not ready for inspection when called.

The following method shall be used in the erection of television antennas:

• A. Fasten mast base securely to roof;

  1. Treat all holes made in roof with sealing material to prevent leakage;

  2. Fasten each screw-eye in material at least three inches thick,

  3. Do not fasten more than two guy wires in one screw-eye or guy wire support,

  4. Minimum size of screw-eyes shall be one-fourth inch by three inches,

  5. Each mast shall be guyed at least every thirteen feet of its height, the top guy to be not more than six feet from the top of the mast,

  6. Guy wire shall be minimum size of 6/20 stranded steel or No. 14 galvanized solid wire,

  7. The distance that the guy wire shall be fastened from the base of the television mast shall be the ratio of one-third its height; a forty-five foot mast shall be guyed at least fifteen feet away from the mast,

  8. The minimum outside diameter of any portion of the mast shall be one inch;

• B. Allow a clearance of at least six feet from said tower and all appurtenant guy wires and other portions thereof, to any power line carrying sixty volts or more of electricity;

• C. Mast or tower shall be grounded at its lowest point with at least No. 8 copper, aluminum or copper clad steel wire;

• D. An approved lightning arrestor shall be installed on the lead-in immediately before it enters the building.

Any person violating any of the provisions of this chapter is guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than three hundred dollars, or by imprisonment in the county jail for not more than thirty days or by both such fine and imprisonment.
