Chapter 8.68 — WATER POLLUTION

8.68.010 - Contamination prohibited.

No person in this city shall contaminate or pollute the water of any drinking fountain, hydrant, or any source or place of storage of the water supply of said city, or of any of its inhabitants.

8.68.020 - Wells—Permit to use.

No person shall maintain any well, spring or tunnel from which drinking water is used without first obtaining a permit from the health officer. The health officer may order said well, spring or tunnel to be closed or filled.

8.68.030 - Wells—Contaminated to be posted.

Whenever the health officer finds that any well, spring or tunnel, used for domestic purposes is contaminated, he shall give the owner written notice to discontinue use of said well, spring or tunnel. The health officer shall take necessary measures to prevent the use of contaminated water from said source and shall post, or shall have posted, a sign warning that the water is unsafe.

8.68.040 - Unsafe water warning signs.

Every person maintaining a water supply for other than domestic purposes, which is contaminated or subject to contamination, shall post on every hydrant, faucet and outlet a sign warning that the water is unsafe. Signs shall be of a type approved by the health officer.

8.68.050 - Cross-connections.

No person shall install or maintain any direct or indirect connection between any part of an approved water system used for drinking purposes and any source, system, tank, vat, fixture, appliance, container or other facility containing water or other substance that is not approved as safe and potable for human consumption, unless the connection is protected to prevent contamination to the approved system in a manner satisfactory to the health officer.

8.68.060 - Drinking fountains.

No person shall maintain any drinking fountain in this city which is insanitary or which is not an approved angle jet type with surrounding guard and operated under adequate pressure.

8.68.070 - Trespassing on waterworks property.

A.

No person shall enter upon or in the waters, or upon the roof or within any building or fence enclosing any reservoir, tunnel, water intake, water treatment plant or water pumping plant, used or usable by the city in connection with its domestic water

supply system and which is located within the city limits without first having secured permission so to do from the general manager of the water and power department of the city, or his authorized representative; provided, however, that the above shall not prohibit the use of certain areas overlying reservoirs which areas have been designated by the city for recreational or other use.

B.

No person shall fish, hunt, boat, bathe, wade or plant or place fish or deposit any garbage, refuse or waste material of any kind in the waters or the enclosed or fenced area surrounding any reservoir, tunnel, water intake, water treatment plant or water pumping plant used or usable in connection with the city's domestic water supply system, and which is located within the city limits.

C.

Authority is given to the general manager of the water and power department to cause to be erected and maintained at or near all reservoirs, tunnels, water intake structures, water treatment plants or water pumping plants owned or operated by the city in connection with the city domestic water supply system, and which are located within the city limits, appropriate signs warning persons that any or all of the following activities are prohibited: Fishing, boating, hunting, camping, riding, hiking, bathing, wading, depositing of any garbage or refuse or waste material of any kind, or any other method of trespass. The erection and maintenance of such signs shall not constitute a condition precedent to prosecution for any offense denounced by this section.

8.68.080 - Trespassing upon water supply lands.

A.

No person shall hunt, boat, bathe, wade, camp or deposit any garbage, refuse or waste material of any kind in the water of any stream or upon the watershed area of any stream used or usable in connection with the city's water supply system where such stream or sections of stream or watershed area is located within the city limits and within the drainage area above a domestic water intake of the city water system.

B.

No person shall fish, hunt, camp, ride, hike, boat, bathe, wade, plant or place fish, or deposit any garbage, refuse or waste material of any kind, or in any other manner trespass upon or in any portion of a stream or watershed area which is usable in connection with the city's domestic water supply system if the health officer has designated such stream or watershed area a critical water supply area; and, provided such stream, section of stream or watershed area is located within the city limits and is on land owned or controlled by the city.

C.

The general manager of the water and power department is authorized to have erected and maintained, at or near all streams, sections of streams or watershed areas which lie within the city limits and which are on land owned or controlled by the city, appropriate signs designed to give warning that designated activities set forth in subsections A and B of this section are prohibited. Such signs shall be located in such places and at such intervals as, in the judgment of the general manager of the water and power department, will give proper notice to members of the public. Where a stream or watershed has been designated a critical water supply area by the health officer, pursuant to the provisions of subsection B of this section, it shall be the duty of the general manager of the water and power department to erect and maintain such signs as the health officer shall require for protecting and posting said area. The erection and maintenance of signs pursuant to this section shall not constitute a condition precedent to prosecution for any offense denounced by this section.

8.68.090 - Plumbing fixtures.

No person shall use or permit to be used in this city any plumbing fixture in any building not provided with a permanent and continuous water supply.

8.68.100 - Contamination by sewage disposal facility.

No person shall construct or maintain any facility for the disposal of sewage which is located wholly or in part within the city after receiving notice from the health officer or the general manager of the water and power department of the city that any of the contents of such facility for the disposal of sewage may tend to injuriously permeate or percolate to or flow into any well, tunnel or reservoir in the city, or into any surface or subterranean spring, stream or vein of water which is used for a public or private domestic water supply in the city.

8.68.110 - Permits for separate sewage disposal facility.

No person shall construct or maintain any facility for the disposal of sewage, which is unconnected to a public sewage disposal system unless he first obtains from the health officer a permit to construct or maintain the same. The permit shall bear the approval of the general manager of the water and power department whenever any such facility is constructed or maintained within 100 feet of any reservoir, well, vein, spring, stream or tunnel containing water to be used for domestic purposes.

8.68.120 - Well standards.

A.

All water wells within the city shall be constructed, maintained and destroyed according to "Water Well Standards: State of California" issued by the Department of Water Resources of the state, as amended or revised from time to time.

B.

All cathodic protection wells within the city shall be constructed, maintained and destroyed according to "Cathodic Protection Well Standards" issued by the Department of Water Resources of the state, as amended or revised from time to time. For purposes of this section, "cathodic protection well" means a well installed to provide protection from electrolytic corrosion of water wells, pipelines, tanks and similar installations by means of vertical deep anodes or other devices.

C.

No person shall drill, dig, sink, construct or destroy any water well or cathodic protection well within the city, or tap or penetrate any portion of the groundwater basin underlying the city unless he first obtains a permit to do so from the general manager of the water and power department or his designated representative. Such person shall strictly comply with all conditions and limitations stated in the permit.

D.

Any person aggrieved by the action of the general manager of the water and power department in granting, denying, conditioning or limiting a permit issued under subsection C of this section may appeal first to the city manager, and then to the board of directors as provided in Article II of Chapter 2.02 of this code.
