4.106.110 - Purpose.

The purpose of this chapter is to support the South Coast Air Quality Management District's (hereinafter "SCAQMD") imposition of a vehicle registration fee pursuant to California Health and Safety Code Section 44223 and comply with the requirements set forth in Section 44243 of said code in order for the city to receive its pro rata share of fee revenues for the purpose of implementing programs to reduce air pollution from motor vehicles.

4.106.120 - Definitions.

As applied in this chapter, the following words and terms shall be defined as follows:

A. "Mobile source air pollution reduction programs" means any program or project implemented by the city to reduce air pollution from motor vehicles which it determines to be consistent with the California Clean Air Act of 1988 or the plan proposed pursuant to Article 5 (commencing with Section 40460) of Chapter 5.5 of Part 3 of the California Health and Safety Code.

4.106.130 - Fund created.

There is created a special fund to be known as the air quality improvement trust fund to account for fee revenue collected pursuant to this chapter.

4.106.140 - Transfer of funds.

The finance director shall deposit funds received from the SCAQMD into the air quality improvement trust fund.

4.106.150 - Use and disbursement of funds.

All revenues received from the SCAQMD and deposited in the fund shall be appropriated and disbursed exclusively on mobile source emission reduction programs as defined in this chapter. Such revenues and any interest earned thereon shall be spent within 1 year of the completion of such programs.

4.106.160 - Interest.

All interest earned by the air quality improvement trust fund shall be part of the fund.
