Chapter 16.20 — RESPONSIBILITIES AND DESIGNATIONS

§ 16.20.010. Director of Economic and Community Development.

The responsibilities of the Director of Economic and Community Development shall include, but are not limited to:

  • (A) To develop forms, procedures and policies necessary for the processing of applications for tentative and parcel maps, parcel map waivers, reversions to acreage, lot mergers and unmergers and other land use actions as provided for in this Title;

  • (B) To review and make recommendations to the Planning Commission with respect to an application's conformance with the General Plan, Zoning Ordinance and any applicable specific plans, and this Title;

  • (C) To ensure that proper environmental review procedures have been conducted, and that proper notice has been provided on all tentative subdivision applications, pursuant to the California Environmental Quality Act (CEQA) and local CEQA guidelines;

  • (D) To confirm that a final map, parcel map or parcel map waiver is in substantial conformance with the approved tentative map;

  • (E) To review and approve voluntary lot mergers and unmergers pursuant to PMC Chapter 16.130 (Lot Mergers/Unmergers). When necessary to carry out these responsibilities, the Director may authorize a designee to act on the Director's behalf.

§ 16.20.020. City Engineer.

The responsibilities of the City Engineer shall include, but are not limited to:

  • (A) Developing forms, standards and procedures for final maps, parcel maps and waivers, reversions to acreage maps, amending maps, certificates of correction, notices of violation, certificates of compliance, and composite development plans, pursuant to this title;

  • (B) Processing lot line adjustments and to issue certificates of compliance;

  • (C) Developing engineering design standards, setting forth design and construction details, and improvement standards and specifications;

  • (D) Processing final maps, parcel maps and waivers, reversion to acreage maps, map amendments, certificates of correction, notices of violation, certificates of compliance, subdivision improvement agreements, and deferred improvement agreements and composite development plans, pursuant to this title;

  • (E) Reviewing tentative and final maps for technical accuracy;

  • (F) Providing technical inspection and approval for all required public improvements and to process notices of completion of improvements;

  • (G) Determining violations of the Subdivision Map Act or this title and to process notices of violation;

(H) Determining whether filings for final maps are complete and timely. When necessary to carry out these responsibilities, the City Engineer may authorize a designee to act on the City Engineer's behalf, in accordance with current state law. (Ord. 1091 § 5, 1996)

§ 16.20.030. Planning Commission.

The Planning Commission is designated as the advisory agency regarding subdivisions, and shall have the authority as follows:

  • (A) To approve, conditionally approve or deny applications for tentative subdivision maps and extensions thereto, parcel map waivers, amendments of final maps pursuant to Government Code Section 66472.1, deferment of improvements, and exceptions to this Title pursuant to PMC § 16.00.040 (Exceptions);

  • (B) To consider and act on any timely appeals of decisions of the Director;

  • (C) To review and approve involuntary lot mergers, and to consider and act on requests for hearing on determination of status regarding the merger of parcels or lots, pursuant to PMC Chapter 16.130 (Lot Mergers/Unmergers);

  • (D) To make recommendations to the City Council regarding an application's conformance with the General Plan, any applicable specific plan, and the Zoning Ordinance with respect to any tentative or parcel map which proposes to create subdivided lots which are less than 7,000 square feet in area, for single-family attached or detached dwellings.

§ 16.20.040. City Council.

The City Council shall have the authority to act as follows:

  • (A) To approve final subdivision maps, reversion to acreage maps, and subdivision improvement agreements and securities;

  • (B) To review and approve amended maps, pursuant to PMC § 16.140.040;

  • (C) To accept land or improvements which are proposed for dedication upon final or parcel maps;

  • (D) To act as the Appeal Board for purposes of hearing and deciding timely appeals of Planning Commission actions on land use issues regulated by this title;

  • (E) To approve, conditionally approve or deny an application for tentative subdivision maps which propose to create subdivided lots which are less than 7,000 square feet in area, for single-family attached or detached dwellings;

  • (F) To approve and accept public improvements constructed as part of a final or parcel map.
