PARKING RESTRICTED TO FACILITATE STREET SWEEPING

The purpose and intent of this Chapter is to restrict parking on City streets for limited periods on designated days to facilitate street sweeping to reduce risks of blocked gutters, flooding, and hazardous conditions associated with flooded public streets.

Uncollected debris or green waste left in City street gutters has the ability to enter into storm drains and clog or completely block gutters, which can result in flooding. Flooding has the capability to block streets and sidewalks, which can create hazardous conditions for pedestrians, cyclists, and motorists.

Further, the uncollected debris or green waste that enters the City's storm drains can affect the health of the environment and animal inhabitants that are located within the creeks, estuaries, and any surrounding bodies of water.

This Chapter is adopted pursuant to the authority granted by California Vehicle Code Sections 22507 and 22507.6, including any successor statutes, for the purpose of restricting parking to facilitate City street sweeping and related procedures.

The purpose of this Chapter is to restrict parking on City streets or portions thereof for the purpose of allowing unobstructed street sweeping. (Ord. 1615 § 14, 2023)

As used in this Chapter, the terms listed below shall have the following meaning assigned to them:

"Entrance" means the intersection of any street or streets comprising an area of restricted parking for street-sweeping purposes on the same day or days and hours with another street or highway not subject to such a parking restriction, or subject to parking restrictions on different days and hours.

"Person" means any natural person, firm, partnership, association, corporation, or other entity of any kind or nature.

"Vehicle" means a vehicle as defined in Section 670 of the California Vehicle Code as the Section now reads or may hereafter be amended.

The definitions set forth in PMC Chapter 1.20 are also applicable to this Chapter.

• (A) Authority to Regulate. The Director is authorized to do the following:

  • (1) Determine the dates and times it is necessary to restrict parking on City streets.

  • (2) Determine the location for placement and install signs restricting parking on any street or portion thereof on which it is necessary to restrict parking.

• (a) All restrictive parking signs shall be installed in a conspicuous place at each street and shall be no less than 17 inches by 22 inches in size, with lettering not less than one inch in height, setting forth the day or days and hours parking is prohibited.

• (3) Use discretional authority to determine and provide exemptions to persons for enforcement of this Chapter including but not limited to exemptions from these provisions for City projects previously approved by the City or if the provisions of this Chapter interfere with an existing special event permit or encroachment permit issued by the City. The Director at his/her sole discretion shall determine whether an exemption applies and if an exemption should be issued.

• (B) Authority to Enforce. All Enforcement Officers, any person or entity designated to do so by the Department, and by an entity or individual authorized pursuant to a written contract with the City to enforce parking regulations are authorized to enforce all provisions of this Chapter.

• (A) Parking Restricted Where Restrictive Parking Signs Are Posted.

  • (1) It is unlawful for any person to stop, stand, physically interfere, or park a vehicle on portions of City streets during the limited periods of time on designated days where authorized signs indicating restrictive parking have been posted on City streets or portions thereof in accordance with this Chapter.

• (B) Exceptions. Subsection (A)(1) of this Section shall apply at all times and places within the City, except as follows:

  • (1) When operating in accordance with an exemption issued by the Director pursuant to PMC § 12.36.030(A)(3);

  • (2) When it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the direction of a peace officer or traffic control device;

  • (3) To any authorized emergency vehicles or a public utility vehicle utilized for responding to emergency incidents;

  • (4) When a more restrictive parking regulation has been established and adopted by the City Council;

  • (5) To any school bus designed and used or maintained for the transportation of any school pupil at or below the twelfth-grade level to or from a public or private school or to or from public or private school activities;

  • (6) When a commercial vehicle is making pickups or deliveries of goods, wares, or merchandise from or to any building or structure located on the restricted street or highway, or for the purpose of delivering materials to be used in the repair, alteration, remodeling, or reconstruction of any building or structure for which a building permit has previously been obtained; and

  • (7) When street sweeping services are postponed by one day due to a holiday observed

by street sweeping provider. (Ord. 1615 § 14, 2023)

Pursuant to California Vehicle Code Section 40000.1, violations of any provision of this Chapter shall be punishable as an infraction pursuant to enforcement procedures set forth in PMC Title 1. Each day that a violation of this Chapter occurs shall constitute a new and separate offense. (Ord. 1615 § 14, 2023)
