§ 8-20

Sec. 8-20.01. - Definitions.

(a)

"Clearing" is the removal of plants, trees and other obstructions from vacant land.

(b)

"Grubbing" is the removal of roots and stumps by digging up vegetation by the roots.

Sec. 8-20.02. - Permits required.

(a)

It shall be unlawful for any person, firm or corporation to clear and/or grub, or cause to have cleared and/or grubbed, on any private or public land without first having obtained a clearing and grubbing permit from the City Engineer.

(b)

Any clearing and grubbing shall be in compliance with such permit and with the requirements of City of Pacifica Administrative Policy No. 45, the terms of which are incorporated by this reference.

(c)

Clearing of sites with mowing or other equipment which does not disturb the root system shall not require a permit.

Sec. 8-20.03. - Violations.

(a)

Any person, firm or corporation violating any provision of this chapter shall be deemed guilty of a misdemeanor, which shall be punishable as set forth in Section 1-2.01 of the Pacifica Municipal Code.

(b)

Whenever any clearing and/or grubbing for which a permit is required by this chapter has been commenced in wilful and knowing violation of this chapter, civil penalties in an amount not to exceed ten (10) times the amount of the required clearing and grubbing permit fee may be assessed prior to issuance of the permit.
