§ 8.20.140. Findings.

This chapter requires the installation of post-construction BMPs for new development and redevelopment projects. As a permittee under the small MS4 general permit, the city is responsible for managing the volume and pollutant load of stormwater runoff the enters the city's storm drain system. In order to ensure the city's compliance with the small MS4 general permit, the city finds that stormwater facilities maintenance agreements for new development and redevelopment projects are required.

§ 8.20.150. Private stormwater facilities maintenance agreement required.

The property owners of new development and redevelopment projects for which building permits have been issued shall enter into a stormwater facilities maintenance agreement with the city prior to the issuance of a certificate of occupancy. The agreement shall be in a form approved by the city council.
