§ 16.08.010. Generally.

  • A. The words, terms and phrases used in this title shall have the meaning commonly ascribed in the English language, except for those terms that are defined in this section.

  • B. All words used in the singular include the plural, and the plural the singular; each gender includes the other; and any tense includes the other tenses unless the context requires otherwise. The word "shall" is mandatory and the word "may" is permissive. The word "includes" shall not limit a term to the specific examples, but is intended to extend its meaning to all other instances or circumstances of like kind or character.

§ 16.08.020. Definitions.

  • A. Definitions, "A."

Access, approved. The right of vehicular travel to a public street, as shown on the final subdivision map or final parcel map and as approved by the city engineer.

Access rights. The right to vehicular and pedestrian entry onto a street from private property.

Alley. A public right-of-way no wider than 30 feet that affords only a secondary means of access to abutting property.

Approved access. See "Access, approved."

  • C. Definitions, "C."

Certificate of compliance. A certificate, recorded by the city, determining that the subdivision of real property complies with the provisions of the Subdivision Map Act and city ordinances enacted pursuant to the Subdivision Map Act. A recorded final map or parcel map shall constitute a certificate of compliance with respect to the parcels of real property described in the map.

City engineer. The director of community development and public works, or his/her authorized representative.

Class I bikeway. An off-street path that is shared by bicycles and pedestrians and that is physically separated from motorized vehicular traffic by an open space or barrier.

Collector street. See "Street, collector."

Corner lot. See "Lot, corner."

Cul-de-sac. A street that connects to other streets only at one end.

Dedication. The granting of land either as an easement or in fee title to a public agency for public uses.

Design. Street alignments, grades and width; drainage and sanitary facilities and utilities,

including alignments and grades thereof; location and size of all required easements and rights-of-way; fire lanes; parcel size and configuration; traffic access; grading; land to be dedicated for park or recreational purposes; and such other specific requirements in the plan and configuration of the entire subdivision that are necessary to ensure consistency with, or implementation of, the general plan or any applicable specific plan, zoning regulation or development policy.

Director of parks. The director of parks and trees, or his/her authorized representative.

Double-frontage lot. See "Lot, double-frontage."

Engineering design standards. The engineering requirements developed by the city engineer, and adopted by resolution of the city council, for the construction and configuration of various types of infrastructure within the city, including, but not limited to, rights-of-way, water and sewer lines, storm drainage and parking areas.

Final parcel map. See "Map, final parcel."

Final subdivision map. See "Map, final subdivision."

Flag lot. See "Lot, flag."

Frontage. The portion of a parcel that abuts one side of a street that provides access to the parcel.

Frontage road. A street that is approximately parallel and adjacent to a freeway or other major street to which access is limited, and that provides access to abutting properties and separation from throughmoving and fast-moving traffic.

Front lot line. See "Lot line, front."

General plan. The general plan of the city, or any element, section or portion of the general plan.

  • I. Definitions, "I."

Improvement. Any street work or utilities to be installed or agreed to be installed by the subdivider, either on site or off site, to be used for public or private streets, highways, ways or easements as a condition of the approval and acceptance of a final subdivision or parcel map; or other specific improvements or types of improvements, the installation of which, either by the subdivider, by public agencies, by private utilities, by any other entity approved by the local agency or by a combination thereof, is necessary or convenient to ensure conformity to or implementation of the general plan or an applicable specific plan, zoning regulation or development policy of the city.

Improvement plans. Maps, drawings, diagrams and calculations illustrating the location and construction plans for all proposed improvements.

Interior lot. See "Lot, interior."

Local street. See "Street, local."

Lot. A parcel of real property that has been lawfully created and recorded, or that appears on one of the maps described in this title; that complies with all applicable Subdivision Map Act requirements; and that complies with all applicable requirements of this Code.

Lot, corner. A lot located at the intersection of 2 or more streets having an angle of intersection of not more than 120 degrees. If the angle of intersection is more than 120 degrees, the lot shall be considered an interior lot.

Lot, double-frontage. A lot that has frontages on 2 streets that do not intersect, not including alleys, and that has the right of access to both streets.

Lot, flag. A lot that has no frontage on any street except for a narrow access strip, and that has boundaries such that another lot is located between the main portion of the flag lot and the street.

Lot, interior. A lot abutting only one street.

Lot depth. The horizontal length of a straight line drawn from the midpoint of the front lot line to the midpoint of the rear lot line.

Lot line. A line bounding a lot.

Lot line, front. In the case of an interior lot, a line separating the lot from the street; and in the case of a corner lot, a line separating the narrowest street frontage of the lot from the street.

Lot line, rear. A lot line that is opposite and most distant from the front lot line. If the lot has an irregular or triangular shape, the rear lot line shall be a line within the lot at least 10 feet in length, located parallel to the front lot line and as far as possible from the front lot line.

Lot width. The horizontal distance between the side lot lines, measured at the front setback.

  • M. Definitions, "M."

Map, final parcel. A map, prepared by a registered civil engineer or a licensed land surveyor and presented for recording, that conforms to an approved tentative parcel map and with the Subdivision Map Act.

Map, final subdivision. A map, prepared by a registered civil engineer or licensed land surveyor and presented for recording, that conforms to an approved tentative subdivision map and with the Subdivision Map Act.

Map, preliminary. A map submitted to the planning commission for recommendations and comments prior to submission of a tentative map.

Map, tentative parcel. A map presented to the planning commission for approval of land divisions that require a final parcel map.

Map, tentative subdivision. A map presented to the planning commission for approval of land divisions that require a final subdivision map.

Map, territorial. A map that an agency has filed with the zoning administrator, indicating the territory for which it wishes to make recommendations regarding tentative subdivision maps.

Map, vesting tentative. A tentative subdivision or parcel map for a residential subdivision that has the words "vesting tentative map" printed conspicuously on its face at the time it is filed and that is processed in accordance with Section 16.12.070 of this title.

Notice of violation. A certificate recorded by the city that determines that real property has been divided or has resulted from a division in violation of this chapter or the Subdivision Map Act.

Parcel. See "Lot."

Pedestrian way. A right-of-way designated for use by pedestrians, equestrians and

bicyclists, and not intended for use as a right-of-way for motor-driven vehicular traffic. A sidewalk adjacent to a street shall not be considered a pedestrian way.

Preliminary map. See "Map, preliminary."

Public sanitary sewer facility. A sanitary sewerage facility provided by a government agency.

Public street. See "Street, public."

Public water supply. A water supply provided by a local agency, publicly owned corporation or approved utility company, subject to provisions of Health and Safety Code Sections 4010 through 4035.

Rear lot line. See "Lot line, rear."

  • S. Definitions, "S."

Setback. The distance between a building, structure or device and one of the parcel's lot lines.

Street, arterial. A street that distributes traffic between freeways and collector streets.

Street, collector. A street that connects local streets to arterial streets and, in some instances, provides direct access to parcels.

Street, local. A street intended principally for direct access to parcels.

Street, public. A street, highway, road, avenue, boulevard, alley, court, circle or drive that has been accepted into a street or road system maintained by the city, county or state. Streets and roads in public parks, public airports, public schools and similar public grounds shall not be considered public streets for the purposes of this chapter.

Subdivider. A person, firm, corporation, partnership or association who proposes to divide, divides or causes to be divided real property into a subdivision for him or herself or for others, except that employees and consultants of such persons or entities, acting in this capacity, are not considered subdividers for the purposes of this chapter.

Subdivision. The division by any subdivider, of any unit or units of improved or unimproved land, or any portion thereof, shown on the latest equalized county assessment roll as a unit or as contiguous units, for the purpose of sale, lease or financing, whether immediate or future, except for leases of agricultural land for the cultivation of food or fiber or the grazing or pasturing of livestock. Property shall be considered as contiguous units, even if it is separated by roads, streets, utility easements or railroad rights-of-way. "Subdivision" includes a condominium project, as defined in Section 1350 of the Civil Code, or a community apartment project, as defined in Section 11004 of the Business and Professions Code. Any conveyance of land to a governmental agency, public entity or public utility shall not be considered a division of land for purposes of computing the number of parcels.

Subdivision Map Act. The Subdivision Map Act of the State (Government Code, Title 7, Division 2, Subdivisions, commencing with Section 66410) and all amendments or additions.
