Chapter 8.38 — RECYCLED WATER USE

8.38.010 - Purpose.

The purpose of this chapter is to meet state law requirements for the use of recycled water through cooperation with the East Bay Municipal Utility District. (Ord. 02-01 § 2 (part))

8.38.020 - Definitions.

For the purposes of this chapter, certain terms have certain meanings, as follows: "Designated recycled water use area" means a precise geographic area in Orinda that can or may in the future be served with recycled water, which has been designated for appropriate uses, in place of potable water. "Non-potable water" means water that is unsuitable for human consumption, including groundwater and other subsurface or surface water that may be used for a beneficial purpose in compliance with applicable local, state and federal laws defining standards for non-potable water uses. "Potable water" means water that conforms to federal, state and local agency standards for human consumption. "Recycled water" means non-potable water that, as a result of treatment, is suitable for certain uses other than human consumption. "The district" means East Bay Municipal Utility District. 8.38.030 - Designation of recycled water areas.

Recycled water can or may in the future be used in areas designated by the district as recycled water use areas. A map showing each designated recycled water use area is on file in the city of Orinda Planning Department Office. (Ord. 02-01 § 2 (part))

8.38.040 - Recycled water use.

City-owned Improvements and Properties. Where appropriate, a new city project within a designated recycled water use area shall be designed to accommodate recycled water in accordance with this chapter. B. Subdivision Applications. 1. Applications. Every application for a subdivision within a designated recycled water use area shall be referred to the district for determination and possible designation by the district of requirements for water reuse, except for applications described in subsection (B)(3) of this section. These requirements may include a plumbing system to serve non-potable uses in the common areas of the subdivision, including, but not limited to, parks, greenbelts, landscaped streets and landscaped medians. The separate plumbing system to serve non-potable uses shall be independent of the plumbing system for domestic residential and other potable water uses in the subdivision. 2. Project Approval. The Planning Commission shall incorporate the requirements determined for a subdivision by the district as conditions of approval of the subdivision. If no requirements have been received from the district at the time of the decision by the Planning Commission, the decision shall impose as a condition of approval whatever requirements may be determined by the district within a specified reasonable period of time after the decision by the Planning Commission. 3. Exempt Applications. A tentative map approved prior to June 18, 2001, or a subdivision map application deemed complete prior to June 18, 2001, is exempt from the requirements of subsection B of this section.
