Chapter 2.28 — HISTORIC LANDMARKS COMMITTEE

A Historic Landmark Committee of the City of Orinda is established. The Committee consists of five (5) members appointed by the City Council. (Prior code § 3-401)

To the extent possible, each member of the Committee shall be a resident of the city. The Committee may include at least one (1) member of the Orinda Historical Society or other historic preservation organization, a preservation architect and a recognized historian. (Prior code § 3-402)

The term of office of each member is three (3) years; however, the initial term expiration date shall be scheduled to expire on February 28th and shall be staggered so that a majority of members' terms do not expire in the same year. Each member serves until a successor is appointed. (Ord. No. 11-06, § 4, 7-19-11)

A member of the Committee may be removed by a majority vote of the Council. A vacancy is filled in the same manner as the original appointment. If a member is absent without cause from three (3) successive regular meetings, the office becomes vacant automatically. The Committee shall promptly notify the City Council of the vacancy. A member is not absent without cause if the absence is due to illness or is unavoidable and the member notifies the Secretary of the Committee before the meeting. (Prior code § 3-404)

A member of the Committee does not receive compensation for serving on the Committee, but is entitled to reimbursement for expenses incurred in the course of duties outside of the city upon approval of the City Council. (Prior code § 3-405)

The Committee shall provide by resolution for the time and place for holding regular meetings, the appointment of its officers and their duties and such rules as it considers necessary for the conduct of its

business, subject to approval of the City Council. Each meeting of the Committee is open to the public and the Committee shall give notice of its meetings as required by law. Three (3) members of the Committee constitutes a quorum for the transaction of business. (Prior code § 3-406)

The duties of the Committee are to: A. Establish a list of proposed historic landmarks for recommendation to the Planning Commission under prior code Section 7-4014(1) of the historic landmark ordinance; B. Disseminate information to the public concerning preservation and enhancement of historic landmarks; C. Encourage and advise property owners of proposed or designated historic landmarks about the preservation and enhancement of the landmark; D. Recommend to the Planning Commission and City Council policies and regulations necessary to administer and enforce the historic landmark ordinance. E.
