Sec. 7-6.01. Purpose and intent.¶
The Council hereby finds and determines that the public interest and welfare require that all utility lines and related facilities, including, but not limited to, wires for supplying and distributing electrical energy and services, including street lighting, telephone, telegraph, and cable television service, to be constructed within the City upon property which is yet undeveloped shall be placed underground as provided in this chapter. Sec. 7-6.02. Requirements.¶
All electrical, telephone, C.A.T.V., and similar service wires or cables which provide direct service to the property being developed shall, within the exterior boundary lines of such property, be installed underground. Risers on poles and buildings shall be permitted and shall be provided by the developer or owner onto the pole which provides service to such property. Utility service poles may be placed on the rear of the property to be developed only for the purpose of terminating underground facilities. The developer or owner shall be responsible for complying with the requirements of this section, and he shall make the necessary arrangements with the utility companies for the installation of such facilities. For the purposes of this section, appurtenances and associated equipment, such as, but not limited to, surface- mounted transformers, pedestal-mounted terminal boxes and meter cabinets, and concealed ducts in an underground system, may be placed aboveground. Sec. 7-6.03. Application.¶
The provisions of this chapter shall only apply to new residential, commercial, industrial, and trailer park (mobile home park) developments. (§ 2, Ord. 1737, eff. October 1, 1970)
Sec. 7-6.04. Exclusions.¶
The provisions of this chapter shall not include or apply to the following: (a) Primary electrical energy transmission facilities operated at nominal voltages in excess of 34,500 volts; (b) Street lighting and traffic control facilities, exclusive of permanent power supply and control circuits which shall be underground;
(c) Facilities necessary to the transmission or reception of radiated wireless communication media; (d) Temporary facilities to supply electrical power or communication services during construction activities or to restore services interrupted by damage to or destruction of existing underground facilities; (e) Utility lines which do not provide service to the area being subdivided; and (f) Any single lot zoned for one-family dwellings and surrounded by improved and developed property which has existing aerial utilities. Sec. 7-6.05. Exceptions.¶
Where the enforcement of the provisions of this chapter would result in undue hardship, property owners may make applications for exceptions from the provisions of this chapter in the following manner: (a) Written applications shall be filed with the Secretary of the Planning Commission. (b) Such applications shall include all the information necessary to properly apprise the Commission of the circumstances existing which require such an exception. A copy of the application shall be forwarded to the City Engineer for his report and recommendations. (c) Within not less than ten (10) days nor more than thirty (30) days after the filing of such application, the Commission shall consider such application and shall make its recommendations to the Council. (d) Within thirty (30) days after the receipt of the recommendations of the Commission, the Council shall consider such recommendation and may grant or deny the application. (e) The filing fees for applications for such exceptions shall be Fifty Dollars ($50.00) or such fees as the Council from time to time shall establish by resolution. Such fees shall be paid to the City at the time of filing. No application shall be considered filed until the established fees have been paid to the City. (§ 2, Ord. 1737, eff. October 1, 1970)
