§ 4-3.401. Permits: Required.

Whenever a permit is required for the use of a City park, it shall be unlawful for a person to use a City park without first having obtained such a permit.

§ 4-3.402. Permits: Applications: Contents.

Whenever a permit to use a City park is required by the provisions of this chapter, an application shall be filed with the City Manager stating:

(a) The name and address of the applicant;

(b) The name and address of the person, group, organization, or corporation sponsoring the activity;

(c) The nature of the proposed activity;

(d) The dates, hours, and park facility for which the permit is desired;

(e) An estimate of attendance; and

(f) Any other information regarding the public health, safety, and welfare which the City Manager finds reasonably necessary to a fair determination as to whether a permit should be issued.

§ 4-3.403. Permits: Standards for issuance.

The City Manager shall issue a permit when he finds:

(a) That the proposed activity or use of the park will not unreasonably interfere with or detract from the public enjoyment of the park;

(b) That the proposed activity or use will not unreasonably interfere with or detract from the promotion of the public health, welfare, safety, and recreation;

(c) That all conditions, including, where applicable, the payment of fees, approval of the Council, indemnification and insurance coverage, are met;

(d) That the proposed activity or use is not reasonably anticipated to incite violence, crime, or disorderly conduct;

(e) That the proposed activity or use will not entail unusual, extraordinary, or burdensome expense or security operation by the City and its Park Department; and

(f) That the facilities desired have not been reserved for other purposes.

§ 4-3.404. Permits: Exhibition.

No person shall fail to produce a permit he or her claims to have upon the request of any Parks Department employee or any peace officer who desires to inspect such permit for the purpose of enforcing compliance with any provision of this chapter.
