Sec. 7.1. - Fence required; exception.

No person shall store, keep or maintain upon any yard, plot, space or tract of land in the city, any scrap iron, secondhand or used machinery, or secondhand furniture, furnishings, or keep, maintain, repair, store, assemble, or disassemble any disabled, unusable, or junk motor vehicle upon any yard, plot, space or tract of land, unless such yard, plot, space or tract of land is enclosed with a view-obscuring fence six (6) feet in height and substantially constructed of materials designed to be in conformance with the standards of the neighborhood. Said vehicle, materials or parts shall not be stored within the front setback or within five (5) feet of any adjoining property line.

This section shall not apply to a duly licensed used car lot business.

Sec. 7.2. - Parking vehicles for sale or service—Prohibited.

(a) No person shall stand or park any vehicle upon any street while displaying such vehicle for sale, or while selling merchandise therefrom, unless authorized by other provisions of this Code. A vehicle shall not be considered to be displayed for sale when it is legally parked on a public street if the vehicle contains a for-sale sign not greater than eight and one-half (8½) inches by eleven (11) inches and the sign is placed on a side window and presents no impediment to the view of the driver when the vehicle is in operation.

(b) No person shall stand or park any vehicle upon any street for the purpose of servicing or repairing such vehicle, except in an emergency; neither shall any person dump, deposit or dispose of engine wastes such as oil, grease or other engine fluids upon any street or roadway.

(c) No person shall stand or park any commercial truck upon any street for the purpose of washing or polishing such vehicle.

(d) No person who deals in or whose business involves the sale, lease or rental of vehicles or whose business involves the transportation of persons by motor vehicles as a charter-party carrier of passengers shall store, stand or park any vehicle upon any public street while the vehicle is held for sale, lease, charter or rental.

(e) No person whose business involves the repair and/or servicing of vehicles and/or vehicle components shall store, stand or park any vehicle upon any public street after that person has accepted custody of the vehicle from the customer.

Sec. 7.3. - Same—Exceptions generally.

The provisions of section 7.2 shall not apply in cases of fires or other emergencies or for temporary parking not in excess of one hour.

Sec. 7.4. - Same—Abatement for violations.

Any yard, plot, space or tract of land which is kept, operated or used in violation of sections 7.1 and 7.2 may be summarily abated as a public nuisance.

Sec. 7.5. - Enforcement of article.

The building inspector and the police department are hereby directed to enforce the provisions of this article.
