The city may withhold issuance of licenses, permits and other entitlements to a responsible party on any project, property, or application of any kind whenever an administrative penalty owed by that party remains unpaid.

The remedies set forth in this section are not exclusive.

1-7.11 Right to Judicial Review. Any person aggrieved by an administrative decision of the zoning, housing and building codes appeals board on an administrative citation may obtain review of the administrative decision by filing a petition for review with the Marin County Superior Court, in accordance with the time lines and provisions as set forth in California Government Code Section 53069.4. In the event that the person aggrieved prevails in the judicial review, the appeal processing fee described within this section shall be waived or refunded, whichever may be applicable.

1-7.12 Notices.

a.

The administrative citation and all notices to be given by this chapter shall be served on or mailed to the responsible person in accordance with the provisions of this chapter and/or any applicable section within this code.

b.

Real Property. When real property is involved in the violation, the original notice, the administrative citation and all notices required to be given by this chapter shall be served on the responsible party and, if different, to the property owner at the address as shown on the last equalized county assessment roll. The city may, in its discretion, also serve notice on a tenant, a mortgagor or any other person having an interest in the property.

c.

Failure to Receive Notice. The failure of a person to receive a required notice shall not affect the validity of any proceedings taken under this chapter.
