§ 5.32.010. Yard sale defined.

"Yard sale" for the purposes of this chapter means any event, which is advertised by any means whatsoever as a place or location to which members of the public may come and purchase identifiable or tangible personal property; provided, however, it does not mean any such event which constitutes a sales activity, wholesale or retail, by any business which has a current business license issued by the city of Norco and does not mean a swap meet as defined in Section 5.28.010 of this title.

§ 5.32.020. Permit required—Issuance conditions.

It is unlawful for any person, corporation, partnership, joint venture, association or any other form of organization to organize, conduct, establish or operate a yard sale in the city of Norco without first obtaining a permit to do so from the city manager or his authorized representative.

The city manager or his authorized representative shall issue a yard sale permit to an applicant if he finds all of the following conditions exist as to the application:

  • (1) The operation or conduct of the requested event will not be contrary to the public peace, health, safety and welfare of the city of Norco; and

  • (2) The applicant has submitted satisfactory evidence that adequate and, safe parking accommodations will be provided for the yard sale; and

  • (3) The location at which the proposed yard sale is to be held is not a location at which a yard sale had been conducted within three consecutive months immediately preceding the date of filing the pending application, and

(4) The applicant has paid the application fee as provided hereinbelow.

Any yard sale permit issued hereunder shall be for a period not exceeding three consecutive calendar days. A permittee granted a permit hereunder shall not conduct a yard sale for a period of time in excess of three consecutive calendar days. (Ord. 684, 1993; Ord. 167 2, 1971)

§ 5.32.030. Permit—Application—Fee.

Application for a yard sale permit shall be made to the city manager on forms provided by him, and shall be accompanied by such fee as has been established by resolution of the city council, which fee shall be used to defray the city's expenses in processing the application. § 5.32.040. Inspection.

All identifiable and tangible personal property, which is exhibited for sale at a yard sale, shall be made accessible by the permittee to law enforcement officials at all times for their review and inspection; and during any such sale the location thereof shall be open by permittee to all fire prevention and health officers of the city for the purpose of their inspection to determine that the sale complies with the city's and stage of California's fire prevention and health regulations.
