12.28.010 - Findings—Purpose of provisions.¶
A. The purpose of this chapter is to establish a time limit for mooring or docking of a vessel to the county-owned boat dock at the Cuttings Wharf Boat Launching Facility located at the south end of Cuttings Wharf Road approximately 3.8 miles south of the intersection of Cuttings Wharf Road and Highways 12 and 121. The board of supervisors finds that it is in the best interest of the public health, safety and welfare to limit the amount of time any one boat or vessel can dock or moor to the county-owed dock on the Napa River so that as many people as possible may safely use the dock to facilitate the launching of their vessels into the water, and also to remove the vessels from the water and load them onto their respective trailers.
B. The board further finds that there has been a recent problem of vessels mooring to the dock for extended periods of time, and unreasonably preventing the use of the dock by other members of the public.
C. The board finds that it is in the best interest of the citizens of the county to institute a time limit so that the greatest number of persons possible have access to the dock.
D. The board finds that a time limit of thirty minutes is adequate for the temporary mooring of any boat or vessel to the dock for the purpose of loading or unloading.

12.28.020 - Definitions.¶
As used in this chapter:
"Dock" means any wharf, pier or other structure which extends into the water, or floats upon the water, provided by the county for public use upon the Napa River.
"Moor" means the fixing of a vessel in one location, temporarily or permanently, by mooring, anchoring, grounding, or any other means.
"Vessel" means and includes ships of all kinds, canal boats, barges, sailing vessels, recreational boats, and every structure adapted to be navigated from place to place for the transportation of merchandise or persons on water.

12.28.030 - Unlawful activities designated.¶
A. It is unlawful for any person to moor any vessel, to assist in the mooring of any vessel, or to allow the mooring of any vessel under his or her control to the county public dock for more than thirty minutes in any four-hour period.
B. It is unlawful for any person to moor a vessel to the county public dock more than four times in any twenty-four-hour period.

12.28.040 - Violation—Penalty.¶
Any person who violates a section or subsection of this chapter shall be guilty of a misdemeanor, which shall be punishable by up to six months in the county jail, and/or a five hundred dollar fine.
