12.12.060 - Maintenance by private owners and occupants.

The owner of record and the occupant of private property upon which any of the classes of trees as defined in Section 12.12.020 is located shall maintain the tree in a healthy and safe condition following the standards set forth in this article.

12.12.070 - Encroaching, constructing or excavating near trees.

When proposed developments or construction may encroach into the dripline of any regulated tree, an arborist report shall be prepared. This report shall contain special construction directions to allow the roots to breathe, obtain nutriments and water may be required as necessary to minimize damage of the existing ground surface within the dripline. Excavation, cuts, fills or compaction of the existing ground surface within the dripline shall minimize damage to the root system. Tree wells may be used where consistent with good standards of cultivation. Such pruning as is done shall not cause permanent injury or destroy any tree. When reviewing proposed development or construction, the planning commission, the design review board and the town staff shall make every attempt to ensure that impacts to trees are minimized.

12.12.080 - Storage of materials and equipment.

No person may store oil, gas, chemicals, heavy construction machinery or other construction materials within the dripline of a tree.

12.12.090 - Attachment of wires and signs.

No person may attach wires or signs (other than a small tree identification sign approved by the town manager or his designee) to a tree.

12.12.100 - Notice of damage to tree to be given to the planning director.

The owner, developer, contractor or agent shall notify the planning director of any damage that occurs to a tree during construction, so that professionally accepted methods of treatment may be administered.

12.12.110 - Subdivisions.

Conditions requiring removal, protection or preservation of trees shall be part of a tentative subdivision map approval. The grading plan shall show the location of trees. Approval of the subdivision map constitutes a permit to remove only the trees so designated on the grading plan.

12.12.120 - Application for building permit.

In the case of an application for a building permit for property which is not within a subdivision which complies with Section 12.12.110, the application for the building permit shall show the location of all existing trees marking those proposed to be removed. The approval by the town of the building permit constitutes a permit to remove the trees proposed to be removed as designated in the application for building permit unless the removal of certain trees is disapproved.
